AN ORDINANCE OF THE CITY OF BOYNTON BEACH,
FLORIDA, AMENDING ORDINANCE 62-9 OF SAID CITY
BY REZONING THREE CERTAIN PARCELS OF LAND
LOCATED IN SECTION 27 AND SECTION 28, TOWNSHIP
45 SOUTH, RANGE 43 EAST, WITHIN SAID MUNICIPALITY,
MORE PARTICULARLY D]ESCRIBED HEREINAFTER, FROM
ZONE R-1AA TO ~ONE R-2, FROM ZONE R-1AA TO ZONE
R'3, AND FROM ZONE C-1 TO ZONE R-~ RESPECTIVELY~
PROVIDING FURTHER FOR SAVINGS CLAUSE, REPEALING
PROVISIONS, AN EFFECTIVE DATE AND FOR OTHER
PUR POSE S
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON
BEACH, FLORIDA:
Section 1: That the following described parcels are hereby rezoned
as follow s:
Parcel No. 1: That portion of the North 100 feet of the North
318.5 feet of the South one-haLf of the Southwest one-quarter of the Southwest
one-quarter, Section 27, Township 45 South, Range 43 East, lying West of the
Intracoastal Waterway right of ways is hereby rezoned from Zone R-iRA
Zone R-2. As a further condition of this rezoning, any structures erected
within said area shall be limited to one-story height.
Parcel No. 2: That portion of the North 318.5 feet, less the
.... North 100 feet of the South one-half of the Southwest one-quarter of the South-
west one-quarter of Section 27, Township 45 South, Range 43 East, lying
West of the Intracoastal Waterway, is hereby rezoned from Zone R-1 AA to
Zone R- 3.
Parcel No. 3: That portion of lhe North 318.5. feet of the South
one-half of the Southeast one-quarter of the Southeast one-quarter, Section 28~
Township 45 South, Range 43 East, lying East of the right of way of U. S.
Highway No. 1, is hereby rezoned from Zone C-1 to Zone R-3.
The Official Zoning Map of the City shall be amended accordingly.
Section 2: Separability: Each of the provisions of this Ordinance
separable, i~cluding word, phrase, clause or sentence, and of any portion
hereof shall be declared invalid, the remaining portion shall not be affected,
but shall remain in full force and effect.
Section 3: Repe. ali.ng Provisions: All ordinances or parts of
ordinances in conflict herewith are hereby repealed.
Section 4: Effect;ive Date: This Ordinance shall become effective
in the manner and at the time provided by the Charter and Ordinances of the
City of Boynton Beach~ Florida.
