AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDAI,
REPEALING PROVISIONS OF ORDINANCE 69-38 OF SAID
CITY, AUTHORIZING ISSUANCE OF CERTIFICATE OF PUBLIC
CONVENIENCE AND NECESSITY FOR OPERATION OF PUBLIC
BUS TRANSIT SYSTEM WITHIN THE MUNICIPAL LIMITS OF
SAID CITY: FURTHER PROVIDING FOR SAVINGS CLAUSE,
REPEALING PROVISIONS, AN EFFECTIVE DATE AND FOR
OTHER PURPOSES:
WHEREAS, the City Council of lhe Cily of Boynlon Beach, Florid
did, on November 3, 1969, adopl Ordinance 69-38 authorizing issuance of
cerlificate of public convenience and necessily for operation of public bus
transil syslern within lhe municipal limits of said Cily lo Joseph Tornberg;
and
WHEREAS, lhe Cily Council has determined that said licensee
has lerminated subjecl service based upon the financial unfeasibility of
continuing operations thereunder;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF BOYNTON BEACH, FLORIDA.:
Section 1: Thai the provisions of Ordinance 69-38 of said
Cily are hereby repealed in lheir enlirety, and lhe cerlificale of public
convenience and necessity issued pursuant therelo is hereby declared null
and void.
Seclion 2: Separability_: Each of lhe provisions of this Ordinanc
are separable, including word, clause, phrase or sentence, and if any
porlion hereof shall be declared invalid, the remaining portion sha~l nol be
affecled bul shall remain in full force and e~ect.
Seclion 3: .Repealing Provisions: All ordinances or paris of
ordinances in conflicl therewilh are hereby r~pealed.
~ection 4: EffecIive Date: This ordinance shall become effectiv
in the manner and at the tirne provided in the charier and Ordinances of lhe
City of Boynton Beach, Florida.
