AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA
DECLARING THE INTENTION OF SAID CITY TO EXTEND ITS
MUNICIPAL TERRITORIAL LIMITS BY THE ANNEXATION OF
CERTAIN UNINCORPORATED TRACTS OF LAND LYING
CONTIGUOUS THERETO AND WITHIN PALM BEACH COUNTY,
FLORIDA, TO WIT: PARCELS OF LAND LOCATED IN SECTIO~
18, 19, 30 and 31, TOWNSHIP 45 SOUTH, RANGE 43 EAST,
AND SECTIONS 5 and 6, TOWNSHIP 46 SOUTH, RANGE 43 EAST
PALM BEACH COUNTY, FLORIDA, MORE PARTICULARLY
DESCRIBED: HEREINAFTER; PROVIDING FURTHER FOR
REPEALING AND SAVINGS CLAUSES, AN EFFECTIVE DATE
AND FOR OTHER PURPOSES:
WHEREAS, the City Council of the City of Boynton Beach, Florid
..deems it essential for the preservation of health, safety and welfare of
inhabitants of said City, and for the efficient daily operation of the municipal
police department, that certain tracts of land lying adjacent and contiguous
i o the Mrritorial limits of the City of Boynzon Beach, Florida, and within
Palm Beach County, Florida, constituti_mg portions of the dedicated right-of-
way of Congress Avenue, be annexed to the municipal limits of said City; and
WHEREAS, subject tracts are uninhabited; and
WHEREAS, subject areas are within the reserve annexation area
of the City of Boynton Beach, Florida, heretofore established;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF BOYNTON BEACH, FLORIDA.:
Section 1: That the City Council of the City of Boynton Beach,
Florida, hereby declares its intention t0 annex the following described tracts
of land to the municipal territorial limits of the City of Boynton Beach,
Florida, at the expiration of thirty days from the passage of this Ordinance.
1. The Easterly 50 feet of the S. E. 1/4 of the N. E. 1/4 of
Section 18, T. 45 S., R. 43 E.
2. The Easterly 50 feet Of the S. E. 1/4 of Section 18, T. 45 S.
R. 43E.
3. The Easterly 50 feet of Section 19, T. 45 $., R. 43 E.
4. The Easterly 50 feet of Section 30, T. 45 S., R. 43 E.
5. The Easterly 50 feet of Section 31, T. 45 S., R. 43 E.
6. The EaSterly 50 feet of the North 2400 feet of Section 6,
T. 46 S., R. 43 E.
7. The ]Easterly 50 feet of the South 1600 feet of Section
6, T. 46 S., R. 43 ]E.
8. The Westerly 50 feet of the Soiiiifil600 feet of Section
5, T, 46S.~ R. 43]E.
Section 2. Repealing Provisions: All ordinances or paris of
ordinances in conflict herewith are hereby repealed.
Section 3: Se~)arabilit~: Should any section or provision of this
ordinance, or any portion hereof, be declared by a Court of competent juris-
diction to be invalid, such decision shall not affect the ,;alidity of the remain-
der hereof as a whole or any part hereof, other than the part declared to be
invalid.
Section 4: That the City Clerk shall proceed with publication of
notice of adoption of this Ordinance in accordance with the Charter of the
City in such cases made and provided.
Section 5: Effective Daie: This ordinance shall become effective
in the manner and at the time provided by the charter and ordinances of the
City of Boynton Beach, Florida.
