AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA,
GRANTING CONDITIONAL USE FOR GASOLINE FILLING STATION
PURPOSES ON PARCEL LOCATED IN SECTION 29, TOWNSHIP
45 SOUTH, RANGE 43 EAST, BOYNTON BEACH, FLORIDA,
MORE PARTICULARLY DESCRIBED HEREINAFTER; PROVIDING
FURTHER FOR SAVINGS CLAUSE, REPEALING PROVISIONS,
AN EFFECTIVE DATE AND FOR OTHER PURPOSES
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON
BEACH, FLORIDA:
Section 1: Thai conditional use is hereby granted to construct and
operate a gasoline filling station on the following-described parcel:
A parcel of land in Sec. 29-45-43 East, City of Boynton Beach,
Palm Beach County, Florida, more particularly described as
follows: From the Northwest corner of Section 29, 45-43, Palm
Beach County, run North 87043'48'' East along the North line of
said Sec. 29 (for convenience, the centerline of State Road S-804
as same appears on the plat thereof in Road Plat Book 2, Page
217 through 220, public records Palm Beach County, Florida,
bears North 87054'06'' East and all bearings recited herein are
relative thereto) a distance of 50.01' to the East line of 100' r/w _
of Congress Ave., thence South 0058'29'' East along said East
line, a distance of 41.19' to the Northwesterly corner and POINT
OF BEGINNING of the herein described parcel of land; thence
North 87043'48'' East, a distance of 200.00' to the Northeast
corner, thence SOuth 0058'29'' East, a distance of 175.61' to
the Southeast corner; thence South 87054'06'' West, a distance of
174.49' to the beginning of curve concave to the Northeast havi~g a
radius of 25.00' and a central angle of 91007'25"; thence Westerly,
Northwesterly and Northerly along arc of said curve, a distance
of 39.76' to end oB said curve and a point Easterly line of the
100.00' wide r/w of Congress Ave.; thence along said Easterly
line, North 0058'29'' West, a distance of 149.51' to point of
beginning, being subject to a drainage Easiement over the North

Section 2: Separability: Each of the provisions of this ordinance
are separable, including word, clause, phrase or sentence, and if any portion
hereof shall be declared invalid, the remaining.portion shall not be affected

Section 3: Repealing Provisions: All ordinances or parts of

Section 4: Effective Date: This Ordinance shall become effective
