AN ORDINANCE OF TIdE CITY OF BOYNTON BEACH, FLORIDA
AMENDING SECTION 3-19 OF THE CODIFIED ORDINANCES
OF THE CITY OF BOYNRON BEACH, FLORIDA, PERTAINING
TO LOCATION OF BEER AND WINE ESTABLISHMENTS;
PROVIDING FOR AUTHORITY TO CODIFY, SAVINGS
CLAUSE, REPEALING PROVISIONS, AN EFFECTIVE
DATE AND FOR OTHER PURPOSES
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON
BEACH, FLORIDA:
.... ~S'Sction 1: That the provisions of Section 3-19 of the Codified
Ordinances of the City of Boynton Beach, Florida, are hereby amended to
read:
"Section 3-19. Beer and wine estal~lishment locations.
No license shall be issued to sell beer or wine at retail
for consumption on the premises within two hundred
(200) yards (measured by straight air line measurement)
from lhe nearest point of the place of business in which
there is an existing license to sell beer, wine or liquor,
for consumption on the premises and the nearest point of
the proposed place of business of such applicant; provided,
however, that this provision shall not apply to licenses
issued or to be issued to applicants for license to sell beer,
or wine in connection with duly Iicensed restaurants and
sold for consumption on premises in conjunction with the
serving of regular meals."
Section 2: Authority to Codify: Specific authority is hereby
granted to codify and incorporate this Ordinance in the City's existing Code.
Section 3: Separability: Each of the provisions of this Ordinance
are separable, including word, clause, phrase or sentence, and if any
portion hereof shall be declared invalid, the remaining portion shall be
affected but shall remain in full force and effect.
Section 4: Repealing Provisions: All ordinance~ or parts of
ordinances in conflict herewith are hereby repealed.
Section 5: Effective Date: This ordinance shall become effective
in the manner and at the time provided in the charter and ordinances of the
City of Boynton Beach, Florida.
