AN ORDINANCE OF THE CITY OF BOYNTON BEACH,
FLORIDA, AMENDING CHAPTER 31 OF THE CODIFIED
ORDINANCES OF SAID CITY BY .ADDING AN ADDITIONAL
SECTION AND TO PROVIDE FOR MINIMUM PERIOD OF
TIME WITHIN WHICH PARTY MAY APPLY FOR ZONING
CHANGE AFTER DENIAL; PROVIDING FOR AUTHORITY
TO CODIFY, SAVINGS CLAUSE, REPEALING PROVISIONS,
AN EFFECTIVE DATE AND FOR OTHER PURPOSES
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON
BEACH, FLORIDA:
Section 1: That Chapter 31 of ~he Codified Ordinance s of the
City of Boynton Beach shall be amended by adding thereto an additional
section, to be known as Section 31-21, which shall read:
'~Section 31-21: If a request is made to rezone any parcel of land
in the City and it is denied by the City Council, there shall be a
mandatory minimum period of eighteen (18) months before any
similar change in zoning may be requested."
Section 2: Authority to Codify: Specific authority is hereby granted
to codify and incorporate this Ordinance in the City's existing Code.
Section 3: Separability: Each of the provisions of this Ordinance
.. ~ are separable, including word, clause, phrase~or sentence, and if any poriio~
hereof shall be declared invalid, the remaining portion shall not be affected
but shall remain in full force and effect.
Section 4: Repealing Provisions: All ordinances or parts of
ordinances in conflict herewith are hereby repealed.
Section 5: Effective Date: This ordinance shall become effective
in the manner and at the time provided in the charter and ordinances of the
City of Boynton Beach, Florida.
