AN ORDINANCE OF THE CI TY OF BOYNTON BEACH, FLORIDA,
AMENDING PROVISIONS OF ORDINANCE 69-29 OF THE
ORDINANCES OF SAID CITY, ESTABL. ISHING~DISTANCES
BETWEEN LOCATION OF FILLING STATION SITES WITHIN
SAID MUNICIPALITY; PROVIDING FURTHER FOR
SAVINGS CLAUSE, REPEALING PROVISIONS, AUTHORITY
TO CODIFY, AN EFFECTIVE DATE AND FOR OTHER
PURPOSES
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON
BEACH, FLORIDA:
Section l: Thai section 2 (AA) (1) A (1) of Ordinance 69-29 of
the City of Boynton Beach, Florida, be and the same is hereby amended
to read:
"There shall be a minimum distance of 1000 feet between' the
nearest property line of the lot or plot of land upon which the
proposed service station is to be constructed, and t:he nearest
property line of a lot or plot of land upon which any other
gasoline service station, church, public playground, hospital,
public school or other similar public or.?semi-pub~ic,~place where
large numbers of people congregate, is located. Such distance
shall be by direct airline measurement.
Section 2: Thai Section 3 (AA) (1) A (1) of Ordinance 69-29 of
the City of Boynton Beach, Florida, be and the same is hereby amended
to read:
"There shall be a minimum distance of 1000 feet between the
nearest property line of the lot or plot of land upon which the
proposed service station is to be constructed, and the nearest
property line of a lot or plot of land upon wl~ch any other
gasoline service station, church, public playground, hospital,
public school or other similar public or semi-public place
where large numbers of' people congregate, is located. Such
distance shall be by direct airline measurement.
Section 3: Separability:Each of the provisions of this ordinance
are separable, including word, clause, phrase or sentence, and if any
portion hereof shall be declared invalid, the remaining porlion shall not
be affected but shall remain in full force and effect.
Section 4: Authority to Codify: Specific authoiily is hereby
granted to codify and incorporate this ordinance in the City's existing Code.
Section 5: Repealin~ Provisions: All ordinances or paris of
ordinances in conflict herewith are hereby repealed.
Section 6: Effective Date: This Ordinance shall become effective
in the manner and at all times provided in the charter and ordinances of t he
City of Boynton Beach, Florida.
