O70-09 AN ORDINANCE OF THE CITY OF BOYNTON BEACH,
FLORIDA, GRANTING CONDITIONAL USES TO PARCELS
MORE PARTICULARLY DESCRIBED HEREINAFTER;
PROVIDING FURTHER FOR REPEALING PROVISIONS,
SAVINGS CLAUSE, AN EFFECTIVE DATE AND FOR
OTHER PURPOSES
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON
BEACH, FLORIDA:
Section 1: Thai conditional uses are hereby granted as indicated
on the folloWing-described pa.~cels of land located within the municipal limits
of the City of Boynton Beach, Florida:
(a) Parcel No. 1: A parcel of land in Section 29, Township 45
South, Range 43 East, beginning at lhe intersection formed by lhe East righl
of way line of Congress Avenue and the South righl of way line of State Road
S804, run thence (1) North 87o54'06" Easl, 200.49 ft. along the South righl
of way line of State Road S804 to a point in said right of way line run thence
(2) South 0°57'06''' East 200 ft. to a point; run thence (3) Soulh 87054'06''
West 200.49 ft. to a point in the Easl right of way line of Congress Avenue;
run thence, (4) North 0057.29" West 200 fi. along said East righl of way line
of Congress Avenue to the point and place of beginning, less the external
area formed by a 25 ft. radius curve lying between tangenls, at the Northwest
corner of lhe above-described premises, Palm Beach County, Florida -
conditional use as gasoline service stalion, in accordance wilh plans and
specificalions now on file in the office of the City Clerk of the City of Boyntor.

(b) Parcel No. 2: The Northeasl corner of U. S. Highway #1 and
S. E. 15th Avenue, having 175 ft. of frontage on ;U. S. #1 measured from
the intersection of the easterly right of way line of U. S. #1 and the Northerl~
exisling righl of way line of S. E. 15ih Ave., along the Easlerly right of way
of U. S. #1 in a Northerly direction to a point in lhe easterly right of way linc
of U. S..J.l; thence Easterly along a line a distance of 175 fi. to a point in the
Northerly existing right of way line of S.E. 15th Ave., thence Westerly alon;
lhe Northerly existing right of way line of S.E. 15th Ave., a distance of 175
feet back to lhe point of beginning. Conditional use as gasoline service
station, in accordance with plans and specifications now on file in the office
of the City Clerk of the City of Boynton Beach, Florida.
The Official Zoning Map of lhe City shall be amended accordingly.
Section 2: Separability: Each of the provisions of this ordinance are
separable, including word, clause, phrase or sentence, and if any portion
hereof shall be declared invalid, the remaining portion shall not be affected
but shall remain in full force and effect.
Section 3: Repealing.. Provisions: All ordinances or parts of
ordinances in conflict herewith are hereby repealed.
Section 4: Effective Date: This Ordinance shall become effective
in the manner and at the time provided in the Charter and Ordinances of the
City of ]Boynton Beach, Florida.
