AN ORDINANCE OF THE CITY OF BOYNTON BEACH,
FLORIDA, GRANTING CONDITIONAL USES TO PARCELS
MORE PARTICULARLY DESCRIBED HEREINAF~I'ER;
PROVIDING FURTHER FOR REPEALING PROVISIONS,
SAVINGS CLAUSE, AN EFFECTIVE DATE AND FOR
OTHER PURPOSES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON
..... BEACH, FLORIDA:
Section 1: Thai conditional uses are hereby granted as indicated on
the following-described parcels of land located within the municipal limits of
the City of Boynton Beach, Florida:
(a) Parcel No. 1: Lois 55, 56, 57, 58, 59, 60 and 61, inclusive,
Lakeside Gardens, according to the plat thereof recorded in Plat BookS, Page
57, in the office of the Clerk of the Circuit Court in and for Palm Beach
Counly, Florida, Less the West 64.49 feet thereof, when measured along the
South line of Lois 58 to 61, inclusive, Lakeside Gardens, according to the plat
thereof, in Section 15, Township 45 South, Range 43 East; being further
described as that part of said Lois 58 lo 61, inclusive, which lie within 50 feet
Westerly of and within 44 feet Easterly of the Baseline of Survey according to
the right of way Map of Section 93010-2501, State Road 5, as filed in the office
of the Clerk of the Circuit Court, Palm Beach County, Florida; and Less that
parl of said Lot 58 of Lakeside Gardens which is included in the external area
formed by a 12 fool radius arc, langent to the North Line of said Lot 58 and
tangenl to a line parallel to and 64.49 feel Easterly of, when measured along
the South line of said Lot 58, the West line of said Lot 58 - conditional use
for trailer sales.
(b) Parcel No. 2: A certain parcel of land lying in Tract A and B,
Block 1 and 2, Palm ]Beach Farms Company, Plat 8, less right of way for
Congress Avenue and Boynton Road and less right of way of L. W. D.D. Canal
#24, Section 30, being more particularly described as follows: Starting at
the poinl of intersection of the West right of way of Congress Avenue and Nortt
right of way of Boynton Road (S. R. 804) running 200 feet West along said North
right of way lo a poini; thence turn North and run 1'64 feet lo a point on the
South right of way of L. W. D.D. Canal #24; thence turn and run 200 feet East
__ along said canal right of way to a point, on the West right of way of Congress
Avenue; thence turn and run South 164 feet along said West right of way lo
the Point of Beginning - conditional use as service station, in accordance with
plans and specifications now on file in the office of the City Clerk of the City
of Boynton Beach, Florida.
The Official Zoning Map of the City shall be amended accordingly.
Section 2: Separability: Each of the provisions of this Ordinance
are separable, including word, clause, phrase or sentence, and if any
portion hereof shall be declared invalid, the remaining portion shall not be
affected but shall remain in full force and effect.
Section 3: Repealing Provisions: All ordinances or parts of
ordinances in conflicl herewith are hereby repealed.
Seclion 4: Effective Date: This Ordinance shall become effective
in the manner and at the time provided in the Charier and Ordinances of the
City of Boynton Beach, Florida.
