AN ORDINANCE OF THE CITY OF BOYiXroN BEACH, FLORIDA, DECLARING THE INTENTIC.~N OF SAID CITY TO EXTEND ITS MUNICIPAL TERRITORIAL LIMITS BY THE ANNEXATION OF AN UNINCORPORATED TRACT OF LAND LYING CONTIGUOUS THERETO AND WITHIN PALM BEACH COUNTY, FLORIDA, TO WIT: A PARCEL OF LAND LOCATED IN SECTION 5, TOWN- SHIP 46 SOUTH, RANGE 43 EAST, ~t~..~LM BEACH COUNTY, FLORIDA, MORE PARTICULARLY DESCRIBED HEREINAFTER; PROVIDING FURTHER FOR REPEALING AND SAVINGS CLAUSES, AN EFFECTIVE DATE ~AND FOR OTHER PURPOSES. WHEREAS, the owner of a certain tract of land more particularly described hereinafter, lying adjacent and contiguous to the territorial limits of the City of Boynton Beach, Florida, and within Palm Beach County, Florida, has petitioned the City Council for the annexation of said property by the City of Boynton Beach, Florida; and WHEREAS, subject tract contains less than ten registered voters; and WHEREAS, it is considered to be for the best interest of the City of Boynton Beach, Florida, and for the owner of subject tract that same be annexed, and included within the municipal territorial limits of the City; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA: Section 1: That the City Council of the City of Boynton Beach, Florida, hereby declares its intention to annex the following-described tract of land to the municipal territorial limits of the City of Boynton Beach, Florida, at the expiration of thirty days from the passage of this Ordinance: SEE ATTACHED DESCRIPTION WHICH IS HEREBY INCORPORATED HEREIN BY REFERENCE AND MADE A PART HEREOF. Section 2: Repealing Provisions: All ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 3: Separability: Should any section or provision of this ordinance or any portion hereof, be declared by a Court of competent juris- diction to be invalid, such decision shall not affect the validity of the remain- der hereof as a whole or any part hereof, other than the part declared to be invalid. Section 4: That the City Clerk shall proceed with publication of notice of adoption of this Ordinance in accordance with the Charter of the City in such cases made and provided. Section 5: Effective Date: This ordinance shall become effective in the manner and at the time provided by the charter and ordinances of the City of Boynton Beach, Florida.
