AN ORDINANCE OF THE CITY OF BOYNTON BEACH~ FLORIDA~
AUTHORIZING ISSUANCE OF CERTIFICATE OF PUBLIC CON-
VENIENCE AND NECESSITY FOR OPERATION OF PUBLIC BUS
TRANSIT SYSTEM WITHIN THE MUNICIPAL LIMITS OF SAID
CITY; FURTHER PROVIDING FOR SAVINGS CLAUSE, REPEAL-
ING PROVISIONS, AN EFFECTIVE DATE AND FOR OTHER
PURPOSES ·
WHEREAS, pursuant to application of Joseph Tomberg for issuance
of a certificate of public convenience and necessity authorizing opera-
tion of public bus transit system within the municipal limits of the
~ity of Boynton Beach~ Florida, and
WHEREAS, after publication of public notice of hearing thereon
and conduct of said hearing, said City Council has determined that the
issuance of subject certificate is justified;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF BOYNTON BEACH, FLORIDA, that authorization is hereby granted
for issuance of a certificate of public convenience and necessity to
Joseph Tomberg for operation of a public bus transit system within the
municipal limits of the City of Boynton Beach, Florida, pursuant to
formal application therefor, previously filed with the office of the
City Clerk. The City Council specifically reserves the right to approve
specific routes of operation of said bus service, as well as rates to
be charged, insurance requirements, quality of service, hours of opera-
tion and any all other reasonable regulations with regard to subject
operation~ in order to protect the interest of the general public.
Separability: Each of the provisions of this Ordinance are
separable ~ including word, clause, .phrase or sentence, and if any
portion hereof shall be declared invalid, the remaining portion shall
not be affected but shall remain in full force and effect.
Repealing Provisions: All ordinances or parts of ordinances in
conflict therewith are hereby repealed.
Effective Date: This ordinance shall become effective the
manner and at the time provided in the ~charter and Ordinances o,~ the
