AN- ORDINANCE OF THE CITY OF BOYNTON BEACH,
FLORIDA, AMENDING ORDINANCE 62-9 OF SAID CITY
BY REZONING TWO CERTAIN TRACTS LOCATED
WITHIN THE CITY OF BOYNTON BEACH, FLORIDA,
MORE PARTICULARLY DESCRIBED HEREINAFTER, FROM
ZONE C1 TO ZONE C2 AND FROM ZONE R1AA TO ZONE
C2; PROVIDING FURTHER FOR SAVINGS CLAUSE,
REPEALING. PROVISIONS, AN EFFECTIVE DATE AND
FOR 'OTHER PURPOSES
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON
BEACH, FLORIDA:
Section 1: The following tracts are hereby rezoned as follows:
TRACT NO. 1: the exact legal description of which is attached
herelo and hereby made a part hereof, is hereby rezoned from Zone C1 to
Zone C2.
TRACT NO. 2: the exact legal description of which is attached
hereio and hereby made a part hereof, is hereby rezoned from Zone R1AA
to Zone C2.
The Official Zoning Map of the City shall be amended accordingly.
The above zoning changes are made specifically subject to the
following condilions, which have been agreed lo by applicant and in the event
of breach of any of said conditions by'applicant or his successors in title,
lhis Zoning Ordinance shall be considered null and void and property reverl
to ils previously designaled zoning classification:
Condition #1: The City Planning Board shall have sile plan
approval of the proposed developmenl at the lime a building permit is
oblained. Such site plan approval shall cdnsider those items outlined in lhe
Planned Unit Development Section of lhe Zoning Ordinance.
Condition #2: The development shall conform lo the requirements,
of lhe minimum properly standards for Muliiple Family Housing (F. H. A. ),
No. 2600, November 1963, pages 35 through 38, and a land use intensity of
7.0 wilh the appropriate conditions of this intensily ratio.
Condition #3: The developer shall, at ils expense, meet all
necessary requirements of the City Engineer, relative installation and
exlension of water and sewer facililies, as well as any necessary highway
alterations or traffic signalization required by influx of lraffic from proposed
developmenl.
Condilion #4: The developer shall enter into a contract with the
City, which will include these conditions.
Section 2: Separability~: Each of the provisions of this Ordinance
are separable, including word, clause, phrase or sentence, and if any
portion hereof shall be declared invalid, lhe remaining porlion shall not be
affected but shall remain in full force and effect.
Section 3: Repealing Provisions: All ordinances or paris of
ordinances in conflict herewith are hereby repealed.
Section 4: Effective Date: This Ordinance shall become effect-
ive in lhe manner and al the lime provided by lhe Charier and Ordinances
of lhe City of Boynton Beach, Florida.
