AN ORDINANCE OF THE CITY OF BOYNTON BEACH
FLORIDA, AMENDING CHAPTER 5 OF THE CODIFIED
ORDINANCES OF SAID CITY BY REPEALING LIMITA-
TIONS ON STORAGE OF BULK GASOLINE; PROVIDING
FURTHER FOR SAVINGS CLAUSE, REPEALING PRO-
VISIONS, AN EFFECTIVE DATE AND FOR OTHER
PURPOSES.
BE IT ORDAINED BY TI-rE CITY COUNCIL OF THE CITY OF BOYNTON
BEACH, FLORIDA:
Section t: That sub-section 505 (d) (4) of Section 5-2 of the Codified
Ordinances of the City of Boynton ~iBeach, Florida, which reads as follows:
"Fifteen thousand gallons storage limit. It shall be unlawful
for any person to construct or install, within the City of
Boynton Beach, facilities for the storage of more than
15,000. gallons of gasoline at, upon or under any one
gasoline filling station service station site, and no permit
shall be granted where the applicant contemplates storage
facilities in excess of the provisions of this section."
~s hereby repealed in it's entirety.
Section 2: Separability: Each of the provisions of this Ordinance are
separable, including word, clause, phrase or sentence, and if any portion
hereof shall be declared invalid, the remaining portion shall not be affected but
shall remain in full force and effect.
Section 3: Repealing Provisions: All ordinances or parts of ordinanc~
in conflict herewith are hereby repealed.
Section 4: Authority to Codify: Authority is hereby granted to codify
and incorporate this ordinance in the City's existing code.
Section 5: Effective Date. This Ordinance shall become effective
in the manner and at the time provided by the Charter and Ordinances of the
City of Boynton Beach, Florida.
