O69-16 ORDINANCE NO 69 16 AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA, GRANTING A SPECIAL EXCEPTION TO CONSTRUCT COMPREHENSIVE. PLANNED UNIT DEVELOPMENT ON PARCEL LOCATED IN SECTION 32, TOWNSHIP 45 SOUTH, RANGE 43 EAS~' , MORE PARTICULARLY DESCRIBED HEREINAFTER, PURSUANT TO PROVISIONS OF ORDINANCE 68-19 OF THE CITY OF BOYNTON BEACH, FLORIDA; PROVIDING FURTHER FOR SAVINGS CLAUSE, REPEALING PROVISIONS, AN EFFECTIVE DATE AND FOR OTHER PURPOSES. ...... PREAMBLE WHEREAS, CALDOS PROPERTIES, INC. has heretofore filed an application ~;.with the City of Boynton Beach, Florida, for the purpose of obtaining approval for a certain comprehensive planned unit development within the municipal limits of said City, as more particularly set forth in said application, and plans and specifications relative thereto, including proposed developmenl plan of additions to PALM BEACH LEISUREVILLE, dated May 1, 1969, all of which items are now on file ..... in the office of the City Manager of said City, on property more particularIY described therein, which items are hereby made a part hereof, by reference, said areas being generally described as follows: Bordered on the West by Congress Avenue; on South by S. W. 23rd Avenue (Golf Road); on the East by E-4 Canal; and on the North by LateraI 26. WHEREAS, the Planning Board of the City of Boynton Beach, Florida, has heretofore approved said development plan and specifications and has recommended favorable consideration thereof by the .~ ~.. City Council, and WHEREAS, the City Council has thoroughly examined said proposed plat, plans and specifications relative thereto, and has received favorable recommendations and approval of said project from the City Manager, the City Engineer and the City Planning Consultant, and WHEREAS, it appears to the City Council that the approval of said proposed comprehensive planned unit development will be in the best interest of the City of Boynton Beach, ~.©W, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA: Section 1: Thai a special exception is hereby granted to CALDOS PROPERTI]ES, INC., the owner of a certain %-tact of land more parlicularly described in items heretofore adopted by reference, for the purpose of proceeding with development of a comprehensive planned unit development in specific accordance wilh development plans and specificalions therefore now on file in the office of the City Manager of the City of Boynton Beach, Florida. Except for the specific special exceptions hereby granted, the developer shall proceed in strict accordance with all ordinances of the City of Boynton Beach, including but not limited to its building, electricaI and plumbing codes, subdivisior~ platting and zoning codes. S. ection 2..Separability: Each of the provisions of this Ordiance are separable, including word, clause, phrase or sentence or sentences, and if any portion hereof shall be declared invalid, the remaining portion shall nol be affected but shall remain in full force and effect. ~ecti. on. 3: Repealing Provisions. All ordinances or paris of ordinances in conflicl herewith are hereby repealed. Seclion 4: Effective Date: This ordinance shall become effective in lhe manner and at the lime provided by the Charier and Ordinances of the City of Boynton Beach, Florida.
