FLORIDA, AMENDING SECTION 25A-6 OF THE
CODIFrlED ORDINANCES OF .SAID CITY, PROVIDING
FOR~DUT-Y OF-SUBDIVIDERS TO MAINTArN ANY-
PRIVATE LAKES,.. CAN-ALS OR WATERWAYS LOCATED
WITHIN PROPOSED SUBDIVISION; FURTHER PROVIDING
FOR SAVINGS CLAUSE~ AUTHORITY TO.. CODIFY,
REPEALI. NG PROVISIONS, AN EFFECTIVE DANTE AND
FOR OTH]ER PURPOSES. _ _
BE IT?0RDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON
BEACH, FLORIDA: ._
Section l: That Section 25A-6 of the Codified Ordinances of
the City of Boynton Beach, Florida, shall be amended by adding an additional
subsection thereto, to be entitled Sub-Section (m), to read:
"(m) Prior to final approval of any plat of land located
wi iht n the munici pal I traits of the Ci fy, whi ch i ncl udes any private lakes,
canal s or other types of waterways, there shal 1 be i ncl uded on the original
plat a formal acceptance by the subdivider, hi s grantees and assigns, of the
responsibility for maintenance of said private lakes, canal s or other water-
ways, and, further, the duty, at their expense, of keeping same free of weeds
hyaci nibs, cloggage or other debris or noxious ma~eri al"
Section 2: Sep. a..rab~ilit_y_i Each of the provisions of this
Ordinance are separable, including word, clause, phrase or sentence, and if
any portiOn hereof shal 1 be declared i nvali d, the remai ni ng portion shall not
be affected but shall remain in full force and effect.
Section 3: Authority to Co~ Specific authority is hereby
granted to codify and incorporate this Ordinance in the City' s existing Code.
Section 4: Repealin.. Provisions:. All ordinances o~'parts of
ordinances in confli ct herewi th are hereby repeal ed.
Section 5: Effective Date: This Ordinance shall become
effective ~n ~'he :manner.and at the time provided by the charter and ordinances
of the City of Boynton Beach, Flori da.
