AN ORDINANCE OF THE CITY OF BOYNTON BEACH,
FLORIDA, DECLARING THE INTENTION OF SAID CITY
TO EXTEND ITS MUNICIPAL T]ERRITORIAL [~IMITS BY
THE ANNEXATION OF AN UNINCORPORATED TRACT OF
LAND LYING CONTIGUOUS THERETO AND WITHIN PALM
BEACH COUNTY, FLORIDA, TO WIT: A PARCEL OF
LAND LOCATED IN SOUTHWEST ON'E-QUARTEt~ OF THE
NORTHWEST ONE-QUAInTER OF SECTI ON 5, TOWNSHIP
46 SOUTH, RANGE 43 ]EAST, PALM BEACH COUNTY,
MORE PARTICULARLY DESCRIB]ED HEREINAFTER;
PROVIDING FOR REPEALING AND SAVINGS CLAUS]E,
AN EFFECTIVE DATE, ZONING PROVISIONS AND FOR
OTHER PURPOSES.
WHEREAS, the owners of a certain tract of land more particular
described hereinafter, lying adjacent and contiguous to the territorial limits
Df the City of Boynton Beach, Florida, and within Palm Beach County, Florida,
aave petitioned the City Council for the annexation of said property by the City
of Boynton Beach, Florida; and
WI-I]EREAS, subject tract contains less than ten registered
voters; and
WriER]FAS, it is considered fo be for the best interest of the Cit'
...... of Boynton Beach, Florida, and for the owner of subject tract that same be
annexed, and included within the municipal territorial limits of the City;
-- ~. NOW, THEREFOR]E, be it ordained by the City Council of the
City of Boynton Beach, Florida:
Section 1: That the CityC;0uncit of the City of Boynton Beach,
Florida, hereby declares its intention to annex the following-described tract
of land to the municipal lerritorial limits of the City of Boynton Beach, Florida
at the expiration of thirty days from the. passage of this Ordinance:
The North 1023.0 feet of that part of the Southwest Quarter
(SW 1/4) of Section5, Township 46 ~uth, Range 43 East,
lying West of the West right ~w~ylin~-~he Seaboard Airline
Railway, logether with the South 330.0 feet of the Southwest
Quarter (SW 1/4) of the Northwest Quarter (NW 1/4) of
said Section 5, Township 46 South, Range 43 East, consisting
of fifty-six acres more or less.
Section 2: That subject property, upon annexation, shall be
zoned to authorize use for light industrial purpose~s, pursuant to the
provisions of Ordinance No. 62-9 of lhe City of Boynlon Beach, Florida,
constituting the master zoning code of said City.
~Seqtion 3: Repealing Provisions: All ordinances or parts of
ordinances in conflict herewith are hereby repealed.
Section 4: Separability:. Should any section or provision of the
ordinance, or-any portion hereof be declared by a court of competent juris-
diction to be invalid, such decision shall not affect the validity of the remainder
hereof as a whole or any part hereof, other than the part declared to be
invalid.
Section 5: Effective Date: This ordinance shall become
effective in the manner and at the time provided by the charter and ordinances
of the City of Boynton Beach, Florida.
