RESOLUTION NO. 90-~O
A RESOLUTION OF THE CITY OF BOYNTON BEACH,
FLORIDA AUTHORIZING THE EXECUTION AND
DELIVERY OF CERTAIN CONSENTS TO SERVICE OF
PROCESS; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Boynton Beach, Florida (the "City") is
contemplating the issuance of certain revenue bonds (the "Bonds");
and
WHEREAS, it is proposed that the Bonds be offered, for sale in
certain jurisdictions, including the states of Alabama,
Massachusetts, Mississippi, North Carolina, South Carolina, and
Tennessee (collectively the "States"); and
WHEREAS, the laws of the States require that prior to the
offering of the Bonds in the States the City file a consent to
service of process appointing the appropriate public official of
the respective States as the agent of the City for the purpose of
receiving service of process; and
WHEREAS, it is necessary and desirable that the City. authorize
the Mayor and the Clerk to execute and deliver consents to service
of process in the forms attached hereto;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF BOYNTON BEACH, FLORIDA.
Section 1. The Mayor and the Clerk are authorized and
directed to execute the consents to service of process attached
hereto. Upon execution, the consents shall be filed with the
appropriate official in the respective States.
Section 2.
This Resolution shall take effect immediately
upon its adoption.
