A RESOLUTION OF THE CITY CON~ISSION OF THE CITY OF
BOYNTON~ BEACH, FLORIDA, ABANDONING A FIVE (5) FOOT
BY EIGHTEEN (18) FOOT UTILITY EASI~rf (BOYNTON BEACH
DISTRIBUTION CENTER); SAID PROPERTY BEING MORE PARTIC-
ULARLY DESCRIBED HEREIN; AUTHORIZING %HE MAYOR AND
CITY CI,ERK TO EXEClYi~ A DISCLAIMER FOR SAID EASIMENT;
PROVIDING THAT THE AITACHED DISC~ BE RECORDED IN
THE PUBLIC RECORDS OF PALM BEACH COUNTY~ FLORIDA;
PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES.
KIqEREAS, Pruitt & Pruitt, P.A., as agents for owner of said
property, has requested the abandonment of the hereinafter described five (5)
foot by eighteen (18) foot utility easement; and
WHEREAS, coranents have been solicited frc~ the appropriate City
Departments; and
WHSREAS, public hearings have been held before the City's Planning
and Zoning Board and the City Comnission on the proposed abandonment; and
WHEREAS, based on the foregoing information, the said easement no
longer serves any useful purpose.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY CORb[ISSION OF THE CITY
OF BOYNTON BEACH, FLORIDA THAT:
Section 1: The City of Boynton Beach, Florida, by and through its
City Conn%ission, does hereby abandon a certain five (5) foot by eighteen (18)
foot utility easement, located in the City of Boynton Beach, Florida, to wit;
The 5 foot by 18 foot utility easement shown along
the southerly portion of the westerly boundary ~of
Lot 18, being contiguous to and abutting the 10 foot
utility easement along the westerly boundary line of
said lot 18, "Boynton Beach Distribution Center',
according to the plat thereof, as recorded in Plat
Book 47, Pages 100 and 101, of the current public
records of Palm Beach County, Florida, containing
90 square feet, mere or less
Section 2: The Mayor and City Clerk are hereby authorized and
directed to execute and deliver the attached Disclaimer and cause the same to be
filed in the Public Records of Palm Beach County, Florida.
Section 3: This Resolution shall take effect immediately upon
passage.
