R22-109 1 RESOLUTION NO. R22-109 2 3 A RESOLUTION OF THE CITY OF BOYNTON BEACH, 4 FLORIDA ASSESSING THE COSTS OF ABATEMENT OF 5 CERTAIN NUISANCES AGAINST THE OWNERS OF THE 6 PROPERTIES INVOLVED; AND PROVIDING AN 7 EFFECTIVE DATE. 8 9 10 11 WHEREAS, a contract vendor was requested by Community Standards to mow the lots, 12 remove vegetation and board up structures on the properties, described in Exhibit "A"; and 13 14 WHEREAS, the owners of the parcel(s) of property hereinafter described were invoiced 15 by the Finance Department in an effort to recoup these costs with no response; and 16 17 WHEREAS, said nuisance was not abated as required; and, 18 19 WHEREAS, all of the property owners listed in the attached Exhibit "A" were sent letters 20 offering them an opportunity to remit within 30 days in order to avoid incurring a lien on their 21 property; and 22 23 WHEREAS, the City Manager or her authorized representative has made a report of 24 costs actually incurred by the City and abatement of said nuisance as to the property(s) 25 involved, which is described in Exhibit "A" attached to this Resolution; and 26 27 WHEREAS, upon passage of this Resolution, the property owners will be furnished with 28 a copy of this Resolution, and given one more opportunity to remit all costs associated with 29 the abatement in full within 30 days of the passage of the Resolution, before transmittal to the 30 County for recordation of Liens; and 31 32 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF 33 BOYNTON BEACH, FLORIDA AS FOLLOWS: 34 35 Section 1: Each Whereas clause set forth above is true and correct and 36 incorporated herein by this reference. 37 38 Section 2: The amount of costs incurred by the City and the abatement of the 39 above-described nuisance as to the parcels of land, owned and indicated to wit: 40 41 42 SEE ATTACHED EXHIBIT "A" 43 S:\CA\RESO\Nuisance Abatement for 08162022-Reso.docx 44 45 Subject amount is hereby assessed as liens against said parcels of land as 46 indicated, plus an additional administrative charge of$30.00 for each Lien. Liens 47 shall be of equal dignity with the taxes there from for the year 2022, and shall 48 be enforced and collected in like manner pursuant to applicable provisions of 49 law. In the event collection proceedings are necessary, the property owner shall 50 pay all costs of the proceedings, including reasonable attorney's fees. 51 52 Section 3.
