A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
CONSENTING TO THE TRANSFER OF A CABLE
TELEVISION FRANCHISE FROM FLAGSHIP CABLE
PARTNERS, FORMERLY KNOWN AS ACCESS CABLE
PARTNERS, TO TELE-MEDIA COMPANY OF
FLAGSHIP, INC.; PROVIDING AN EFFECTIVE
DATE; AND FOR OTHER PURPOSES.
~S, on the 17th day of July, 1984, the City
Commission of the City of Boynton Beach, Florida, by
Ordinance No. 84-29, granted a non-exclusive license to
Access Cable of West Boynton, Inc., to operate a community
antenna television system within certain areas of the City
of Boynton Beach, Florida; and
WHEREAS, on the 5th day of February, 1985, by Ordinance
No. 85-10, Access Cable of West Boynton Beach, Inc., was
granted permission to operate its community antenna
television system throughout the City limits of the City of
Boynton Beach, Florida; and
W~EREAS, Michelson Media, Inc., and Access Cable of
West Boynton Beach, Inc., entered into an agreement whereby
Access Cable of West Boynton, Inc., sold, transferred or
assigned all of its right, title and interests in providing
cable television service as se~ forth in Ordinance No. 84-29
to Access Cable Partners now known as Flagship Cable
Partners; and
W~EREAS, said transfer was approved by the City
Commission by Resolution No. 87-D on the 6th day of January,
1987; and
WI{EREAS, pursuant to Section 7-26(d) of the Code of
Ordinances, City of Boynton Beach, no such sale, transfer or
assignment shall be made without the prior consent of the
City Commission expressed by Resolution; and
WHEREAS, Flagship Cable Partners, formerly known as
Access Cable Partners hereby requests consent of the City
Commission for the sale, transfer and/or assignment of said
franchise to Tele-Media Company of Flagship, Inc.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF BOYNTON BEACH, FLORIDA;
SECTION 1: The City Commission hereby consents to
the sale, transfer and/or assignment of the non-exclusive
license from Flagship Cable Partners, formerly known as
Access Cable Partners to Tele-Media Company of Flagship,
Inc., as set forth in Ordinance No. 84-29 and 85-10 of the
City of Boynton Beach, Florida. By accepting this sale,
transfer and/or assignment, Tele-Media Company of Flagship,
Inc., hereby agrees to comply with the terms and provisions
of said non-exclusive license and further to comply with the
provisions of Chapter 7 of the Code of Ordinances, City of
Boynton Beach, Florida, which provisions are hereby adopted
by reference and made a part hereof as if set forth herein.
Section 2: This Resolution shall become effec=ive
upon passage.
