88-OOORESOLUTION NO. 88-000 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, REQUESTING STATE COMPLIANCE WITH CRITERIA GUIDELINES SET FORTH FOR THE LANTANA CORRECTIONAL INSTITUTION; AUTHORIZING THE CITY CLERK TO TRANSMIT COPIES OF THIS RESOLUTION TO THE DEPARTMENT OF CORRECTIONS; THE GOVERNOR OF THE STATE OF FLORIDA; THE MEMBERS OF THE CABINET OF THE STATE OF · T FLORIDA, HE: LEGISLATIVE'DELEGATION OF PA ; THE BOARD OF COUNTY PALM BEACH COUNTY; WITHIN PALM C · OUNTY, AN EFFECTIVE DATE; AND FOR WHEREAS, there currently exists within the corporate limits of the Town of Lantana, corrections facilities within the complex of A. G. Holley Hospital; and WHEREAS, these prison facilities are owned and operated by the State of Florida Department of Corrections; and WHEREAS, in accordance with State Statutes and rules pro- mulgated by the State Department of Corrections and codified in the Florida Administrative Code, one of the programs at the A. G. Holley complex is Lantana Correctional Institute (LCI), a highly specialized institution designated to provide specia~ treatment for youthful offenders who are substance abusers; and WHEREAS, LCI is the only prison facility within the State of Florida placed in this specific category; and WHEREAS, the criteria to be utilized for placement of inmates at LCI and sanctioned by the Department of Corrections provides for age restrictions of 26 and below and for inmates who have no prior history of overt, aggressive behavior; and WHEREAS, inmates placed at LCI must be those convicted of nonviolent offenses and inmates sentenced for robbery may on__q]j~ be considered if the offense did not result in injury to the victim or if the presence of such inmate in the institution would not cause undue concern among the residents of the community; and WHEREAS, the State Department of Corrections has admitted that they have, in fact, neglected to follow their own criteria for placement of inmates; and WHEREAS, the State Department of Corrections by this negli- gence, has placed the citizens of the Town of Lantana and surrounding communities in jeopardy through events which have undeniably threatened life and property; and WHEREAS, the residents of the City of Boynton Beach join the Town of Lantana and surrounding communities in expressing concern about this threatening situation in which they and their children have been placed through the State's noncompliance with its own rules and regulations; and WHEREAS, since the State Department of Corrections has recently announced plans to shift the inmate population of LCI to female offenders, the City Commission of Boynton Beach hereby requests that the same criteria for nonviolent, nonaggressive inmates be uti- lized and strictly followed for the proposed female inmates; and NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF BOYNTON BEACH, FLORIDA, THAT: Section 1. The City Commission of the City of Boynton Beach requests absolute compliance with promulgated and adopted criteria for placement of inmates at the Lantana Correctional Institution in accor- dance with State Statutes and that there be no change in the existing criteria even if the prison population is shifted to female offenders and that the criteria of all other programs be strictly complied with. Section 2. The City Commission of the City of Boynton Beach insists upon continued ability of the Town of Lantana to review inmate files in order to assure the residents of the Town of Lantana and surrounding communities that only nonviolent, nonaggressive, offenders are placed at this facility in accordance with promulgated rules and State Statutes. ~ection 3. The City Clerk of the City of Boynton Beach is authorized and hereby directed to provide copies of this resolution to the State Department of Corrections, the Governor of the State of Florida, to all members of the Florida State Cabinet; to the legisla- tive delegation of Palm Beach County; to the Board of County Commissioners of Palm Beach; and to all municipalities within Palm Beach County.
