Brown, Chief ' Bureau of Election Records DATE: October 19, 2022 SUBJECT: 2021 Report of Minority and Physically Disabled Appointments Section 760.80, Florida Statutes, requires statutorily created decision making and regulatory boards, commissions, councils, and committees to submit a report to the Secretary of State annually by December 1. A copy of the report must also be submitted to the Governor,the Speaker of the House of Representatives, and the President of the Senate. The Minority Appointment Reporting Form (DS-DE 143) can be downloaded from the Division's website at dos.myflorida.com/elections/forms-publications/forms. To submit by email to the Department of State, please send as a .pdf attachment to: MinorityReports@dos.myflorida.com. The Minority Appointment Report discloses the number of appointments made during the preceding year from each minority group and the number of non-minority appointments made, expressed both in numerical terms and as a percentage of the total membership of the board, commission, council, or committee. In addition, information must be included in the report detailing the number of physically disabled persons appointed to the boards, commissions, councils, and committees in the previous calendar year. Proposed Resolution No. R21-152 - Authorize the Mayor to sign all documents associated with the acceptance and grant agreement for the Edward Byrne Memorial Justice Assistance Grant (JAG) for $40,482 subject to the approval of the City Attorney. 10 Meeting Minutes City Commission Boynton Beach, FL November 16, 2021 have come to understand that Boynton Beach is experiencing tremendous economic growth, primarily because of the great work of David Scott, our Economic Director, and the CRA. This is something everyone wants. What concerned the clergy is that the development of Boynton was not being guided through an equity lens. The cliché, a rising tide lifts all boats is not true if your boat got holes in it. And what if you don't have a boat period? When development is not conducted through an equity lens, it places the residents of the Heart of Boynton at risk for displacement. He stated for the record when he says Heart of Boynton, he is talking about the entire historic black community of Boynton. He said you can begin to understand how excited the clergy became once we became aware that the City is the lead in the effort to create an equity initiative. What excites us most is how you chose to develop this initiative. The broad base you have included all groups that face inequalities, capturing data so that the recommendation is not based on emotion. Getting feedback from multiple stakeholder groups, hosting town hall meetings. And finally, you will take those findings and provide an equity blueprint for key stakeholders to follow. This is spot on. With that said, none of us needed this study to know the following as it relates to the Heart of Boynton. One, the solutions are bigger than the City government. Two, the Heart of Boynton will have the highest concentration of inequity findings because of historic Jim Crow segregation policies. We are fortunate to have leaders from faith, civic, social services, health, and labor organizations. We are already meeting and learning how we can work in a collaborative and not a competitive manner. We are looking to ensure that the residents of the Heart of Boynton will become resilient to the negative consequences of gentrification. We want to ensure that the Heart of Boynton develops without displacement. We know nobody is commonly going to hear me now. Commissioner Romelus encouraged Mr. Whitely to finish his statement at the appropriate agenda item. 5. Administrative A. The City needs to do something to honor the first black woman firefighter in Boynton Beach. How can the community be part of the memorialization of Chief Clemons? Mayor Grant stated that there will be a discussion on the consideration of naming the Urban Orchard after Chief Clemons. The Commission will do what they can to make things right. Pastor Whitely inquired how will the ideas on memorializing Chief Clemons from the community be collected. Mayor Grant responded that the City is open to all options. Review and approve priorities for the Public Art Program as drafted by the Art Advisory Boardduring the public workshop on August 21 , 2021 and approved by the Art Advisory Board during its regular meeting on September 9, 2021 . Glenn Weiss, Public Arts Manager, gave a summary of recommendations from the public workshop on August 21 , 2021. The Board's focus is on diversity. They have renewed their commitment to the Kinetic event it is the City's premier event that separates Boynton from Palm Beach County and South Florida. The Board did recognize that the Kinetic event needed more community engagement. They did evaluate other elements and one thing they want to continue is to be the largest public art collection of Palm Beach County Artists. Almost all 80 artworks are from South Florida artists or from artists in our region and they want to maintain that. They want to support the good distribution of public art throughout the City, yet at the same time, have a concentration in downtown. They want to get better, because they do not feel it is as good as it could be, that the public information, which goes out about the public art program. They want to proceed with new programs such as the murals. More collaborations with City departments and community agencies, they would like to see how they can enhance their fund raising and how we can enhance our engagement with K through 12 education. Commissioner Penserga thanked Mr. Weiss for working with the Art Advisory Board. These are great recommendations. It says here with Private Collaboration and Support, could you elaborate on what that means, because, to me public art it is not just about putting art in the public, but actually having public participation in the art. Mr. Weiss responded that has to do with the financial attributes that our money should be kind of seed money to make other artwork happen. As you will see, actually the draft Mural Ordinance and Guidelines and program has been completed, and is now working its way through the process. There is a great deal of community engagement in relationship to the making of the work and the planning of. Commissioner Penserga inquired about the financing of future art projects. Are there any 12 Meeting Minutes City Commission Boynton Beach, FL September 21, 2021 Mayor Grant stated ever since they heard about the crash on June 24, 2021, they have been working to make sure City structures are safe. He mentioned Condo Associations and questioned if they have the authority to make repairs to buildings. He also questioned if they could tell an Association their structure is unsafe and uninhabitable. City Attorney Cherof replied that they do not. The Building Official has those powers under Florida Law; however, those are not derived from the City Charter or Code, they are independent. The City Commission and City Manager do not direct or limit the Building Official for fulfilling statutory responsibilities. Currently, their Building Official says the building is habitable. Mayor Grant indicated that until there is other information, that is where they are at. They are looking to make changes, so they can do something. They want to make sure they are in step with all the other 38 municipalities in Palm Beach County. They understand that Boca Raton wanted to be first in the State of Florida, and they can change their ordinance if they wish, but we can be more restrictive than the County. The motion passed unanimously. 11 Meeting Minutes City Commission Boynton Beach, FL September 8, 2021 Program. The SHIP Program is funds that are allocated from the state of Florida to counties and municipalities. AHAC use to meet when the City received $360,000 or more. With the change in legislature last year now the Committee has to meet on a regular basis. The Committee is composed of 11 members who will review incentives that come from the State Housing Finance Corporation from the state of Florida. With the purpose of providing or revising the laws and regulations that are in place within the City to be able to help the way for affordable housing in the community. The Committee will meet at least three times during the year to review these 11 incentives and prepare a report that he goes back to the state and also presented to the Commission in March. Commissioner Penserga thank Mr. Ramirez for the information and inquired about the HUD language was there any further details on any criteria for these volunteers to be a member of the AHAC besides the categories that are listed on the appointments document. Mr. Ramirez stated that members that participate on the AHAC can be from anywhere in South Florida. The do not have be a resident of Boynton Beach. They need to have experience in the category that they are representing. For instance, a person that will represent as an advocate for low income person will have to have some sort of experience working with people that are low income persons. Mayor Grant stated that there was a walk on applicant for the AHAC. Motion Commissioner Romelus nominated Sari Vatske as the advocate to low income persons to the AHAC. Commissioner Penserga seconded the motion. The motion passed unanimously. Motion Commissioner Penserga nominated Dr. Stephanie Hayden-Adeyemo as the representative of essential services personne o the AHAC. Commissioner Katz seconded the motion. The motion passed unanimously Motion Commissioner Katz nominated Kevin .scher as the citizen serving on the local planning agency to the AHAC. Commissions enserga seconded the motion. The motion passed unanimously. Commissioner Romelus inquired about her term on the AHAC does it expire once she is out of office. Mr. Ramirez responded since the position has to be filled by an elected official her term on the board will be terminated once she is no longer an elected official. Commissioner Romelus asked if the Committee will be meeting on a quarterly basis. 14 Meeting Minutes City Commission Boynton Beach, FL September 8, 2021 Commissioner Penserga stated that he is intrigued with this proposal and he does look forward to seeing something more complete. He asked that staff reaches out to Mr. Terrano so he is aware of what is needed to make that proposal. Ernest Mignoli, 710 NE 7th Street he moved here permanently and bought property in October of 2020. There are children that live in his building it is a 28-condo building. There residents who ignore all the fire codes and regulations of using propane grills and gasoline for their boats. He called the fire marshal to come out and they sent someone and somehow, they removed the propane He spoke with the fire marshal the next day and was informed that the propane tank is not supposed to be within 25 feet of the building. Mr. Mignoli stated that the association and their contractors were installing pilings in the Intercoastal, which you need federal, state, and county permits. The contractors showed up in unmarked trucks, unmarked workers and they jumped over our fences damaging the fences and worked all day in the intercoastal pulling and installing pilings. Since nobody says anything he makes the phone calls. It is mind-boggling and it is continuing. He does not like being in this situation. Every time he gets involved with the police or with the City he receives threatening emails from his neighbors and the board files police reports against him. Look what happened at 624 in Surfside. That should serve as one of the greatest motivations to clean up everything. Making sure residents are not doing things that are not supposed and to make sure the officials are doing what they are supposed to do. He feels that he does not get help from the police and fire departments. If there is no actual crime that is happening the police are not going to report it. It is speechless what they are doing wrong. They will not talk to me about anything. I can ask for inspection report, can I get a financial report, can I get an engineering report the answer is always no. How can they get away with it? Mayor Grant inquired if Mr. Mignoli has filed his complaints with the State of Florida. Mr. Mignoli responded he just got over cancer. He will try to get his complaints filed. Mayor Grant stated that he appreciates Mr. Mignoli coming to the meeting an putting his concerns on record. It is something that the City can keep an eye on. However, there is only so much that the City can do. Mr. Mignoli may need to report this to the county and to the state as well. Mr. Mignoli stated that he does not agree with the Mayor. 5. The reason he wanted to read the list Mr. Weiss provided, is that list in and of itself would be sufficient to establish the structure for conducting the meeting, which Mr. Weiss would moderate using that agenda and with the assistance of the Chair, of course, but also give the public the opportunity to know what is going to be discussed without having to come over and find out. That eliminates the opportunity for anybody to argue later on that ideas and concepts and recommendations to the Commission were developed in secret. Commissioner Romelus agreed, as long as the City is within purviews of the law in the terms of Sunshine and noticing the public, as long as we are doing that, we should allow the board to be able to, again, take this initiative to hopefully bring us back something that is productive and that will paint an image or paint a picture, no pun intended, of what the future of our arts program can look like. City Manager LaVerriere requested that the Commission keeps in mind staff time and the cost. The City Clerk will have to be there. It is potentially several hours on a weekend. We have to maintain recording. We have to do minutes. We have to support that meeting like all of our other advisory boards. We have limited staff in the Clerk's Office. Moving forward if this becomes popular to be mindful of that impact on City staff. Commissioner Romelus stated if that is one of the concerns in terms of trying to have staff come in on the weekend and do all that, perhaps we dictate that the workshop happens on a weekday perhaps after hours. That way staff members can just stay a couple of hours after the workday and help conduct the workshop. Mayor Grant stated it goes back to the agenda, the Commission will approve or not approve. He asked for a consensus from the Commission to allow the Art Advisory Board to propose an agenda and bring back to the Commission for approval. Does this open it up to all the advisory boards to come back with us for a special agenda? The answer is, yes, it does. However, it is something that the Commission understands that this is taxpayer money being used to have these meetings for their volunteer time. It is something we have to weigh the cost versus benefits. Art has the benefits of economic aspects for our City. This is important to the City's future. City Attorney Cherof stated that it would. Tom Warnke, Executive Director of the Surfing Florida Museum, 2780 Wister Road, stated that the Recreation and Parks Advisory Board met last Monday, April 26th and at this meeting the Board unanimously approved recommending moving forward with a plan to put the Florida Surfing Museum in the Historic Women's Club building. Mr. Warnke requested to know the next steps and if this could be placed on the next Commission meeting agenda. Mayor Grant questioned if this would give staff enough time to prepare. City Manager LaVerriere stated that staff would need a little more time than the next meeting. She added that this is the first time she is hearing of the recommendation. Vice Mayor Penserga stated that he has requested the videos and recordings of advisory board meetings, such as the Planning and Zoning Board, from staff and he has not received anything. Mayor Grant stated that, in regards to the video, he understands captioning could be an issue. He added that maybe staff could look into expending funds on captioning for the advisory boards so these Zoom meetings could be made available to the public. City Manager LaVerriere stated that staff is following Florida Statute in regards to public meetings and records retention and the minutes are made available to the public once completed. City Manager LaVerriere recommended reviewing the current policy regarding meeting recordings and video recording and bringing this back for discussion at the June meeting. Discussion of revisions to Advisory Board Ordinance Commissioner Katz suggested changing the language that allows the boards to select their chair and vice chair. Commissioner Hay agreed with Commissioner Katz that the Commission should not be involved with appointing the chair and vice chair to the boards. We have enough of a challenge trying to appoint people to the boards. Mayor Grant concurred with Commissioners Katz and Hay. There was a consensus that boards will have the ability to appoint their own chair and vice chair. Vice Mayor Penserga pointed out that there were additional changes made to the Ordinance. Attorney Cherof recommended that the chair and vice chair for the Planning and Development Board, Library Board and the Art Advisory Board be appointed by the City Commission. Vice Mayor Penserga agreed with Attorney Cherof that the City Commission should appoint the chair and vice chair to Planning and Development Board, Library Board and the Art Advisory Board. Commissioner Romelus suggested that the Planning and Development Board, Library Board and the Art Advisory Board appoint the chair and vice chair, then go to City Commission for ratification. 9 Meeting Minutes City Commission Boynton Beach, FL April 6, 2021 Deputy City Clerk Stanzione clarified that the applicants listed for the Planning and Development were not previously serving on the Board. They are looking to be appointed for the new term. Mayor Grant remarked that Mr. Fischer had served on the Planning and Development Board previously. Deputy City Clerk Stanzione replied that Mr. Fischer was not serving when this term expired; he is looking to serve again. Mayor Grant thanked Deputy City Clerk Stanzione for the clarification. Are the members not just reappointed like Mr. Rosecrans? Have they reached their maximum term and could be on the board? Attorney Cherof replied the Ordinance provides that no member shall be appointed for more than two consecutive terms. The clause essentially terms the board members out. Commissioner Romelus remarked that makes sense. These four members will continue to serve until other individuals present themselves. At that point the Commission will appoint a new member and the current member's term will end. Kathryn Matos, Assistant City Manager, replied the City consolidated reappointments through the Ordinance. Typically, terms expired throughout the year. One of the purposes of the Ordinance was to consolidate this process so that it is an annual process. All board member terms expire on March 31st. If they want to reapply and be reappointed, it happens one time every year as opposed to every meeting. This does not cover vacancies due to people resigning throughout the year. Commissioner Romelus requested further clarification on the applicants: If they are not on the board anymore, do they continue to serve month-to-month? Attorney Cherof replied that the board members continue to serve month-to-month until their seat is filled. This way the boards are not short members and are able to conduct business until the seat is filled. He questioned if the City will be offering such funding to the small businesses within the City. Mayor Grant believed that all of the City's funding had been distributed. Lori LaVerriere, City Manager, responded that there are programs out there that Mr. Hoffman might qualify for. Ms. LaVerriere suggested that Mr. Hoffman give her office a call in the morning, either she or Mr. Scott would be able to talk to him about what programs are available. Annette Gray, 1600 Gateway Boulevard, Suite 220, announced that on February 13th, a group of nonprofits in the area are sponsoring a Valentine's Day event for the homeless. Some of the services that will be available are haircuts, showers, laundry, a food truck and a pallet of clothing. Katherine Uden, South Florida Campaign Organizer for Oceana, thanked the Commission for the discussion and consideration for an ordinance banning the use of polystyrene within the City. As of 2015, companies have produced 400 million tons of plastic annually, it is expected to quadruple by 2050. Polystyrene foam is not only bad for the oceans, it is bad for human health. The United States is responsible for some of the highest plastic inputs into the ocean. By reducing plastics in Boynton Beach, the City is protecting the environment, Florida's coastal economy and the livelihood of its residents. While Oceana works on state and federal action, They encourage Boynton Beach to pass legislation to reduce plastics and polystyrene foam. Tom Warnke, 2780 Wooster Road, commended the Commission and the City of Boynton Beach for moving forward with Eco Park off of Quantum Boulevard. Mr. Warnke's father was part of the City Commission 35 years ago when the City approved the industrial park off of Quantum Boulevard. One of the requirements was for land to be set aside for a preserve. Mr. Warnke and his wife walked the trails and it is just beautiful. He thanked the Commission again for working on this. 5. And when you get ready to brand the City, keep in mind the things that we do have the Gulfstream come the closest to the continental united states in Boynton Beach than any city in our country. We are a mile and a half from the ocean, 1-95. I mean you just go right down the line. I would like to talk to you when you get further into your branding and just give my thoughts to the committee. This Commission has shown great leadership and will continue to do so as we approach it with thoughtfulness and intentionality. That is what's different than some of our other sister cities. It happened and they respond. We are creating it. You, as a Commission, and our public have created the destination that they would like to see in our City. And we have an opportunity to make sure that what we create is diverse and inclusive because we want everyone to see themselves in the future of Boynton Beach. The strategies, the destination, the amenities, the experience centers have to be intentionally curated so that everyone sees themselves in the City, race, creed, color, gender. We are doing it with purpose. Commissioner Romelus noted she was a member of the Tourist Development Council (TDC) Board, and thanked the individuals from Discover the Palm Beaches who are here to really who also support our staff in producing this. I think this is revolutionary in how we continue to do business here in Boynton Beach, focused on the tourism industry. We had a pretty intense meeting last week at the TDC Board where we discussed the future of tourism, especially with everything in mind that is happened with Covid. I think this will put us definitely ahead of the curve by the fact that we have now set the precedent in our plan in terms of tourism. This is great I am glad that we are just so ahead of the game and that we are doing the right thing. Meeting Minutes City Commission Boynton Beach, Florida January 5, 2021 problems. Would like to know if the City is working with other police departments and what kind of progress is being made. If we inherit other cities' problems, it is not helping anybody. He is aware that there was an unpermitted event that took place during the holidays. He would like to see more clamping down on these large scaled events that are not permitted. He expressed that he feels this may have prevented some of the people coming to Boynton. Vanessa Belmonte said she is moving to Boynton Beach on January 13th and is very excited about joining the community. Would like to see more greenspace in downtown Boynton instead of another condominium. She is joining the DBC and would like to see an extension on the zoning decision for the Legacy project. Dr. Stephanie Hadden-Adeyemo, 2181 SW 15th Avenue, condo N102, said the City has a lot of concrete and she would also like to see more greenspace and wants to build communities and not concrete jungles. Commissioner Katz clarified that the item that is on the agenda later is privately owned property and it is a private developer with land coming to the City.
