87-RRRA RESOLUTION OF THE CITY COMMISSION
OF THE CITY OF BOYNTON BEACH, FLORIDA,
VACATING AND ABANDONING A 12 FOOT WIDE
DRAINAGE EASEMENT HEREINAFTER DESCRIBED;
AUTHORIZING THE MAYOR AND CITY CLERK TO
EXECUTE A DISCLAIMER FOR THE SAID
EASEMENT TO BE VACATED; PROVIDING AN
EFFECTIVE DATE; AND FOR OTHER PURPOSES.
WHEREAS, Jon C. Yergler, agent for Post Landing
(Boynton), Ltd., has requested the abandonment of a 12
foot wide drainage easement hereinafter described; and
WHEREAS, comments have been solicited from the
appropriate City Departments; and
W~RREAS, public hearings have been held before the
City's Planning and Zoning Board on September 8, 1986,
and the City Commission on September 15, 1986, on the
proposed abandonment; and
WHEREAS, based on the foregoing information, the 12
foot wide drainage easement which is hereby abandoned no
longer serves any useful purpose.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY
COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA THAT:
Section 1:
The City of Boynton Beach, Florida,
by and through its City Commission, does hereby vacate
and abandon a drainage easement located in the City of
Boynton Beach, Florida, to wit:
12 FOOT WIDE DRAINAGE 'EASRMENT SECTION
18, TOWNSHIP 45 SOUTH, RA}~GE 43 EAST
CITY OF BOYNTON BEACH, PALM BEACH
COUNTY, FLORIDA being a 12 foot wide
Drainage Easement lying within the Plat
of Post Landing, as recorded in Plat
Book 54, Pages 191 and 192, Public
Records of Palm Beach County, Florida,
being more particularly described as
follows: Commencing at the East 1/4
corner of Section 18, Township 45 South,
Range 43 East; thence South 01° 44' 21"
West along the East line of said
Section, a distance of 524.00 feet;
thence North 88° 15' 39" West, a
distance of 303.53 feet to the POINT OF
BEGINNING of the centerline of a 12 foot
Drainage Easement; thence South 59~ 58'
00" West along the said centerline, a
distance of 139.23 feet; thence South
09~ 02' 28" East, a distance of 50.59

feet to the POINT OF TERMINATION of the
centerline of said 12 foot Drainage
Easement. Containing 0.05 of an Acre.
SUBJECT to existing Rights-of-Way,
Easements, Restrictions and Reservations
of Record.
Section 2: The Mayor and City Clerk are hereby
authorized and directed to execute and deliver the
attached Disclaimer and cause the same to be filed in the
Public Records of Palm Beach County, Florida.
Section 3: This Resolution shall take effect
immediately upon passage.

DISCLAIMER
KNOW ALL MEN BY THESE PRESENTS that the City of Boynton
Beach, Florida, a municipal corporation, under the laws of
the State of Florida, does hereby abandon and disclaim a
certain 12 foot wide Drainage Easement situated and located
in Palm Beach County, Florida, attached hereto as Exhibit
IN WITNESS WHEREOF, the duly authorized officers of ~h~
City of Boynton Beach, Florida, have hereunto set their
hands and affixed the seal of the City this 8th day of
October , 1987.
