87-QQQA RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
FINDING AND DECLARING THAT A CERTAIN
AREA WITHIN THE CITY IS BLIGHTED;
ADOPTING BY REFERENCE THE BLIGHT
DETERMINATION FINDINGS AS SET FORTH IN A
STUDY COMPLETED BY THE CITY'S PLANNING
DEPARTMENT; DECLARING A NEED FOR
REHABILITATION OF SUCH AREAS; PROVIDING
AN EFFECTIVE DATE AND FOR OTHER
PURPOSES.
WHEREAS, the City Commission of the City of Boynton
Beach finds and declares that one or more slum and blighted
areas exist within the City of Boynton Beach, and that the
rehabilitation, conservation, or redevelopment, or a
combination thereof, of the area is necessary in the
interest of the public health, safety, morals, or welfare of
the residents of the City of Boynton Beach; and
WHEREAS the Boynton Beach Planning Department has
completed a blight study of the Redevelopment Area, and said
study made certain findings relating to the blighted
condition of the area; and
WHEREAS, The City Commission of the City of Boynton
Beach has previously created a Community Redevelopment
Agency as a public body as provided in Florida Statute,
Chapter 163, Part III, Section 163.356; and
WHEREAS, the City Commission of the City of Boynton
Beach by the adoption of Resolution No. 82-KK, as amended by
Resolution No. 84-II, has declared an area of the City to be
the Redevelopment Area; and
WHEREAS, the Mayor and City Commission of the City of
Boynton Beach find it necessary to designate the new areas
as part of the Community Development Project.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1. One or more slum and blighted areas
exist in the City of Boynton Beach.

Section 2. The rehabilitation, conservation and
redevelopment or a combination thereof of such area .or areas
is necessary in the interest of public health, safety, morals
of the residents of such County and
and welfare
Municipality.
Section 3.
That the City Commission hereby expands
the area previously designated as blighted or slum area by
addition of the following desCribed areas, legal

description attached hereto as Exhibit "A".
Section 4. It is further resolved that

A street layout that is predominately defective
and inadequate.
B. A lot layout that is faulty in relation to size,
adequacy, accessibility and usefulness.
C. An area that suffers from unsafe and unsanitary
conditions.
D. An area that, to a significant degree, has
deterioration of site and other improvements.
E. An area that has diversity of ownership which
prevents the free alienability of land.
F. An area in which there exists faulty and
inadequate street, parking facilities, roadways
and bridges.
G. An area in which there exists the deterioration of
housing and overcrowding.
H. An area with an elevated crime rate and incidence
of juvenile delinquency.
Section 5. The blight determination study done by
the Boynton Beach Planning Department is hereby adopted and,
by reference, incorporated herein and attached hereto as
Exhibit "B".
Section 6. This Resolution shall take effect
immediately upon adoption.

Statistical Analysis
for New Redevelopment Area
The below is a listing of all Part 1 crimes in the area specified in Mr. Cheney's
memo dated August 20, 1987. The statistics are for the year~,1985, 1986 and 1987
to date. Included in the statistics are non-criminal calls (UCR reportable) calls
handled which give a general overview of the area, i.e. City Ordinance Violations,
Vandalism and Warrant Arrests. The statistics for 1984 are not included as the
PIDAS information has been purged.
In addition to the activity listed below, and in response to the question on
"Juvenile Delinquency", I have included the Juvenile arrests for eachof the years
listed in the survey. ,The Juvenile arrests gives totals in the area of consider-
ation and from these I have separated arrests which involve some form of violence,
i.e. Aggravated Battery, Resisting Arrest With Violence, Simple Battery and others.
The printouts from the PIDAS computer have been placed in file folders by year for
any material not included that may be required by the Community Redevelopment Board.
The statistical breakdown is listed by verbiage in the preface of each catagory.

RESOLUTION NO. 87-~
A RESOLUTION OF THE CITY COMMISSION
OF THE CITY OF BOYNTON BEACH, FLORIDA,
ADOPTING A SANITATION RATE SCHEDULE.
WHEREAS, Ordinance No. 86-36 has been adopted deleting
from the Boynton Beach Code of Ordinances Chapter 10, "Garbage, Trash
and Offensive Conditions", Article II, "Refuse, Garbage and Trash",
Section 10-29, "Rates and Charges for City Service" and further pro-
viding for a new Section 10-29 "Rates and Charges for City Service"
by providing that such rates and charges shall be adopted by
Resolution of the City Council.
NOW, THEREFORE, BE IT RESOLVED by the City Commission the
City of Boynton Beach, Florida:
Rates and Charges for City Service.
The following rates and charges shall be made for refuse
collection service provided by the City.
A. Commercial Containerized, excluding Residential Units:
(1) Monthly commercial charges shall consist of a
total of the following six items:
(a) Container rental charge - A monthly charge
to cover the actual cost of the container
(amortized over five (5) years) as annually
calculated and certified by the City
Council. The certified container rental
charge will be as follows:
2 cu yd container - $3.95 per month
3 cu yd container - $4.85 per month
4 cu yd container $5.43 per month
6 cu yd container - $7.37 per month
8 cu yd container - $8.25 per month
(b) Disposal charge - A fixed charge per cubic
yard as charged by the Palm Beach County
Solid Waste Authority for disposal of waste
at the landfill as annually calculated and
certified by the City Council. The amount
certified as the disposal charge for 1987/88
is thirty dollars ($30.00) per ton.

(c) Operating charge - A fixed charge per pick
up to cover the operating cost less disposal
cost. The operating charge for 1987/88
will be twenty-six dollars {$26.00) per
month per pick up.
{d) Capital equipment charge - A fixed charge
per pick up to cover total capital costs for
vehicles as annually calculated and cer-
tified by the City Council. The certified
capital equipment charge for 1987/88 will be
seven dollars and ninety-five cents {$7.95}
per month per pick up.
{e} Overhead charge - The monthly overhead
charge will be as follows:

(f) Landfill closure charge A fixed charge of
eighty cents ($.80) per cubic yard per pick
up will be charged to meet the cost of closing
the City's landfill.
Partial monthly service will be charged on a pro-
rated basis, as appropriate, based on the guide-
lines in {1) above.
Removal charges for mechanically compressed
refuse in a dumpster shall be computed at three-
to-one {3:1) {containers furnished by owners).
Two {2} or more places of business establishments
using a single container shall share equally the
charges for the container per pick up as outlined
in {1) above. Any joint use generating two {2}
cubic yards or less per month shall be charged a
minimum of forty-five dollars {$45.00} per month
to be shared equally.
Section 2.
B. Non-Containerized Commercial Service:
(1) Refuse picked up from bins shall be charged at
twenty-two dollars ($22.00) per cubic yard
(non-compacted measure). Small businesses
generating one cubic yard a month or less shall
be charged at the rate of twenty dollars-two
($22.00) per month.
(2) Refuse picked up from residential type cans at
commercial establishments shall have their level
of service negotiated by the Public Works
Department with an opportunity to appeal the rate
to City Council.
C. Residential Rates (Non-containerized):
(1) Ten dollars and twenty-five cents ($10.25) per
month for single family dwellings.
(2) Ten dollars and twenty-five cents ($10.25) per
month for each family unit duplex or triplex.
(3) Ten dollars and twenty-five cents(S10.25) per
month for each family unit for apartments and
condominiums.
(4) Trailer parks, ten dollars and twenty-five
cents ($10.25) per month per trailer.
D. Residential Rates (Containerized):
(1) Nine dollars and sixty cents ($9.60) per month
for each family unit for apartments and con-
dominiums that are served by high volume con-
tainers (containerized).
(2) Nine dollars and sixty cents ($9.60) per month
per trailer in trailer parks.
E. Special Pick Up - Scheduled:
Special Pick Up will be scheduled by contacting the
Public Works Department.
F. Roll-off container collection will be charged $100.00
per transfer plus the actual cost of the landfill
charge. (Roll-off container will be supplied by user
of service).
This Resolution shall become effective on
October 1, 1987,
