A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
ABANDONING AN ALLEY RIGHT-OF-WAY LOCATED
SOUTH OF THE PUBLIC WORKS COMPLEX WHICH
IS LOCATED ON N.E. 9TH AVENUE AT N.E.
1ST STREET, SAID PROPERTY BEING MORE
PARTICULARLY DESCRIBED HEREIN;
AUTHORIZING THE MAYOR AND CITY CLERK TO
EXECUTE A DISCLAIMER FOR SAID ALLEY
RIGHT-OF-WAY; PROVIDING THAT THE
ATTACHED DISCLAIMER BE RECORDED IN THE
PUBLIC RECORDS OF PALM BEACH COUNTY,
FLORIDA; PROVIDING AN EFFECTIVE DATE;
AND FOR OTHER~PURPOSES.
WHEREAS, Carmen S. Annunziato, agent for The City of
Boynton Beach, has requested the abandonment of the
hereinafter described alley right-of-way; and
WHEREAS, comments have been solicited from the
appropriate City Departments; and
WHEREAS, public hearings have been held before the
City's Planning and Zoning Board and City Commission on the
proposed abandonment; and
WHEREAS, based on the foregoing information,
alley right-of-way no longer serves any useful purpose.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF BOYNTON BEACH, FLORIDA THAT:
Section 1: The City of
and through its City Commission, does hereby abandon a
certain alley right-of-way located in the City of Boynton
Beach, Florida, attached hereto as Exhibit A.
Section 2: The Mayor and City Clerk are hereby
authorized and directed to execute and deliver the attached
Disclaimer and cause the same to be filed in the Public
Records of Palm Beach County, Florida.
Section 3: This Resolution shall take effect
immediately upon passage.

EXHIBIT "A"
TWO right-of-ways in Section 21, Township 45
South, Range 43 East, City of Boynton Beach, Palm
Beach County, Florida. Being more particularly
described as follows:
A 30 feet dedicated road right-of-way, 344.86 feet
in length, lying between BLOCK 1 and BLOCK 2 of
CONGRESS GROVE, a subdivision in said City of
Boynton Beach as recorded by the Clerk of the
Circuit Court in and for said Palm Beach County in
Plat Book 13 Page 63. The platted name for said
30 foot right-of way being Congress Court.
AND
A 10 foot dedicated alley right-of-way, 384.9 feet
in length, lying between the following two groups
of lots: LOTS 121, 122, 123, 124, 125, 126 and
LOTS 114, 115, 116, 117, 120 all in ARDEN PARK a
subdivision in said City of Boynton Beach as
recorded by said Clerk of the Circuit Court in
Plat Book 2 Page 96.
