87-MM ESOr UTION NO. A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE ON BEHALF OF THE CITY AN INTERLOCAL AGREEMENT BETWEEN THE CITY AND PALM BEACH COUNTY RELATING TO THE UTILITY CONSTRUCTION IN SEACREST BOULEVARD, A COPY ATTACHED AND MADE A PART OF THIS RESOLUTION. BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA: Section 1. The Mayor and City Clerk are directed and authorized to execute on behalf of the City an Interlocal Agreement between the City and Palm Beach County, relating to the utility construction in Seacrest Boulevard. Section 2. A copy of the Interlocal Agreement is attached to this Resolution and made a part hereof. Section 3. This Resolution shall take effect upon its passage and adoption. CITY OF BOYNTON BEACH, FLORIDA ATTEST: City ~rk Mayor Vice MayUr Commissioner Commls sione~ (Corporate Seal) AGREEMENT BETWEEN PALM 'BEACH COUNTY AND THE CITY OF BOYNTON BEACH FOR THE FUNDING OF UTILITY CONSTRUCTION IN SEACREST BOULEVARD THIS AGREEMENT, made and entered into this day of · . , 1987, by and between Palm Beach County, a political subdivision in the State of Florida, herein referred to as "COUNTY" and the City of Boynton Beach, a political sub- division in the State of FlOrida, herein referred t~o as "CITY", W I TNE S SE T H : WHEREAS, COUNTY and CITY desire to. jointly participate in the construction of certain utilities within right of .way of Seacrest Boulevard from Boynton Canal to Hypoluxo Road; and WHEREAS, Florida Statutes, Section 163.01, allows governmental units to make the most efficient use of their powers by enabling them to cooperate with other governmental units, on a basis of mutual advantage; and WHEREAS, the execution of is in the best interest of both governmental units by promoting efficient utility construction -along the Seacrest Boulevard right-of-way referred to previously; NOW, THEREFORE, for an in consideration of the mutual covenants conta~ined herein, the Parties to this Agreement agree as follows: 1. The COunty, as part of its road construction project, (Project Number 84186) shall have certain utilities constructed, as shown on plan sheets 80A thru 100A (both inclusive) of 100, titled "City of Boynton Beach, FL, Utility Adjustments"; and 2. The City agrees to pay directly to the County all costs attrib,utable to said utility construction as outlined and detailed on Pages P-5 and P-6 of the Standard Contract Specifications for this project; and 3. Said summation of costs is stated as "Alternate Bid" on Ra.~e P-7B of Standard Contract Specificatons in the amount of $320~448.75; and 4. Said costs shall be adjusted upon completion of the project using as constructed quantities~ said quantities being measured by the Survey Section of the Engineering Services Division of the Palm Beach County Engineering & Public Works Department. 5.· The City 'agrees to fund those contributions set forth_in Paragraphs 1 through 4 above within ten (10) days of receiving written notice from the County that funding is required. 6. The County is to be responsible for administering the funds in accordance with this Agreement. 7. All provisions of this Agreement calling for the expenditure of ad valoreTM tax money by either COUNTY or CITY are subject to annual budgetary fUnding and should either Party involuntarily fail to fund any of their respective obligations pursuant ~o this Agreement, this Agreement may be terminated.
