87-KRESOLUTION NO. 87-,~ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA, CONSENTING TO THE TRANSFER OF A CABLE TELEVISION FRANCHISE FROM GROUP W. CABLE, INC., TO COMCAST CABLEVISION CORPORATION OF FLORIDA, PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. W~RREAS, on the 5th day of August, 1968, the City Council of the City of Boynton Beach, Florida, by Ordinance No. 68-17; granted a non-exclusive license to Teleprompter Corporation, to operate a community antenna television system within certain areas of the City of Boynton Beach, Florida; and WHEREAS, on the 3rd day of March, 1982, by Resolution No. 82-Q, the City Council of the City of Boynton Beach, Florida, authorized the reorganization of Teleprompter Corporation into Group W. Cable, Inc., permitting operations under the license granted to Teleprompter Corporation and WHEREAS, Group W. Cable, Inc., has notified the City of Boynton Beach that it wishes to sell, transfer or assign all of its right, title and interests in providing cable television service as set forth in Ordinance No. 68-17 and Resolution No. 82-Q to Comcast Cablevision Corporation of Florida; and WHEREAS, pursuant to section 7-26(d) of the Code of Ordinances, City of Boynton Beach, no such sale, transfer or assignment shall be made without the prior consent of the City Council expressed by Resolution; and WHEREAS, Group W. Cable, Inc., and Comcast Cablevision Corporation of Florida, both hereby request consent of the City Council for the sale, transfer and/or assignment of said franchise. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA; SECTION 1: The City Council hereby consents to the sale, transfer and/or assignment of the non-exclusive license from Group W. Cable, Inc., to Comcast Cablevision Corporation of Florida as originally set forth in Ordinance No. 68-17 and Resolution No. 82-Q of the City of Boynton Beach, Florida. By accepting this sale, transfer and/or assignment, Comcast Cablevision Corporation of Florida hereby agrees to comply with the terms and provisions of said non-exclusive license and further to comply with the provisions of Chapter 7 of the Code of Ordinances, City of Boynton Beach, Florida, which provisions are hereby adopted by reference and made a part hereof as if sen forth herein.
