RESOLUTION OF THE BOYNTON BEACH CITY
COUNCIL APPROVING AN AGREEMENT BETWEEN
THE CITY OF BOYNTON BEACH AND THE LAW
FIRM OF SIEMON, LARSEN, MATTLIN & PURDY.
WHEREA~, the City of Boynton Beach desires to
contractually engage the services of Siemon, Larsen, Mattlin
& Purdy to assist in the legal aspects of the lawsuits
involving Tradewinds Development Corporation, Kieran J.
Kilday, Joseph Molina and Lake Boynton Estates Homeowners
Association, Inc., and
W~R. REAS, the law firm of Siemon, Larsen, Mattlin & Purdy
desires to assist the City of Boynton Beach in the legal
aspects of the aforementioned lawsuits,
NOW, THEREFORE, BE IT RESOLVED BY THE BOYNTON BEACH CITY
COUNCIL, assembled in special session this 24th day of
February, 1987, that the Agreement between the City of
Boynton Beach and the law firm of Siemon, Larsen, Mattlin &
Purdy, attached hereto and made a part hereof, is approved,
and the Mayor and Clerk of this Council are authorized, in
their respective capacities, to execute said Agreement on
behalf of the City of Boynton Beach, Florida.

AGREEMENT BETWEEN THE CITY OF
BOYNTON BEACH AND SIEMON, LARSEN MATTLIN & PURD¥
~S AGREEMENT made and entered into this day
of
· 1987, by and between the City of Boynton
Beach, and the law firm of Siemon, Larsen, Mattlin & Purdy, whose
address is 1900 Glades Road, Suite 401, Boca Raton, Florida,
33431.
WITNESSETH:
W~EREAS, the City of Boynton Beach desires to engage the
contractual services of Fred W. Mattlin, with the law firm of
Siemn, ~sen, Mattlin & Purdy to assist the City in the legal
aspects of the lawsuits involving Tradewinds Development Corpora-
tion, Klex'an j. Kilday, Joseph Molina and Lake Boynton'Estates
Homeowne~Association, Inc. (the "litigation"),
WHEREAS, Fred W. Mattlin desires to assist the City of
Boynton Beach with the litigation,
Now, THEREFORE, in consideration of the mutual covenants
and_~_gr~ments expressed herein the parties hereby agree as fol-
lows:
5. The City of Boynton Beach agrees to engage the
contractual services of the law firm of Siemon, Larsen, Mattlin &
Purdy to-assist the City in connection with the litigation.
'--2. The law firm of Siemon, Larsen, Mattlin & Purdy
agrees to assist the City of Boynton Beach in connection with the
litigation.
3.- The City of Boynton Beach agrees to pay the law
firm of Si~emon, Larsen, Mattlin & Purdy, as compensation for
legal serv/ces furnished hereunder, at an hourly rate between $75
and $125 per hour.
~4. The City of Boynton Beach 9grees to pay directly or
reimburs~ ~the law firm of Siemon, Larsen, Mattlin & Purdy the '
actual ~am.~unts of any expenses and costs incurred during the
course of said legal representation, which may include but is not
limited to-court reporter bills, postage, duplicating, travel

exp~nses, long distance telephone charges, delivery charges,
Printin~ charges, filing fees and other like charges.
5.~ The parties agree that the law firm of Siemon,
Larsen, Mattlin & Purdy is acting as an independent contractor
and is not an employee of the City of Boynton Beach.
6. This a~reement may be terminated by either party
upon written notice to the other and said termination shall be-
come effective upon receipt of said notice.
7. The foregoing terms and conditions constitute the
entire agreement between the parties hereto and any representa-
tions not contained herein shall be null and void and of no force
or effect. Further, this agreement may be amended only in writ-.
ing upon mutual~consent Of the parties hereto.
