87-DRESOLUTION NO. 87- D
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
BOYNTON BEACH, FLORIDA, CONSENTING TO THE TRANSFER
OF A CABLE TELEVISION FRANCHISE FROM ACCESS CABLE
OF WEST BOYNTON, INC., TO ACCESS CABLE; PROVIDING
AN EFFECTIVE DATE; AND FOR OTHER PURPOSES.
~tEREAS, on the 17th day of July, 1984, the City
2ouncil of the City of Boynton Beach, Florida, by Ordinance
~o. 84-29; granted a non-exclusive license to Access Cable
Df West Boynton, Inc., to operate a community antenna
~elevision system within certain areas of the City of
~oynton Beach, Florida; and
W/~EREAS, on the 5th day of February, 1985, by Ordinance
No. 85-10, Access Cable of West Boynton Beach, Inc., was
granted permission to operate its community antenna
television system throughout the City limits of the City of
Boynton Beach, Florida; and
WHEREAS, Michelson Media, Inc., and Access Cable of
~est Boynton Beach, Inc., have entered into an agreement
~hereby Access Cable of West Boynton, Inc., will sell,
~ransfer or assign all of its right, title and interests in
~roviding cable television service as set forth in Ordinance
[o. 84-29 to a partnership between Michelson Media, Inc.,
and Access Cable of West Boynton, Inc., to be known as
Access Cable Partners; and
WHEREAS, pursuant to Section 7-26(d) of the Code of
Drdinances, City of Boynton Beach, no such sale, transfer or
· ssignment shall be made without the prior consent of the
2ity Council expressed by Resolution; and
W~EREAS, Access Cable Partners and Access Cable of West
~oynton, Inc., both hereby request consent of the City
~ouncil for the sale, transfer and/or assignment of said
franchise.
NOW, T~RREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
tHE CIT~OFBOYNTON BEACH, FLORIDA;
SECTION 1: The City Council hereby consents to the
~ale, transfer and/or assignment of the non-exclusive
from Access Cable of West Boynton, Inc., to Access
Partners as originally set forth in Ordinance No.
of the City of Boynton Beach, Florida. By accepting
sale, transfer and/or assignment, Access Cable
· hereby agrees to comply with the terms and
)rovisions of said non-exclusive license and further to
:omply with the provisions of Chapter 7 of the Code of
~s, City of Boynton Beach, Florida, which provisions
hereby adopted by reference and made a part hereof as if
forth herein.
SECTION 2:
passage.

This Resolution shall become effective
