OPENINGS: A. Call to Order - Mayor Gerald Broening Mayor Broening called the meeting to order at 5:47 p.m. He said that the Commission will immediately recess to an executive session to discuss some legal matters as prescribed by law and the meeting will resume at 6:30 p.m. Assistant City Attorney Cirullo announced that pursuant to Section 286.011 of the Florida Statutes, the City Attorney's office has requested a closed-door client/attorney session to discuss the matter of Boynton Beach Alliance, et al. vs. the City of Boynton Beach. Present at this meeting will be Mayor Broening, Vice Mayor Weiland, Commissioners Ferguson and McCray, the City Manager, Assistant City Attorney and the court reporter. Presentation of a $300,000 grant award to the City of Boynton Beach by Henry Dean, Executive Director and Pat Gleason, Member of the Governing Board of the South Florida Water Management District (S.F.W.M.D.) Mayor Broening welcomed Alvin Jackson, Deputy Executive Director of the Water District; Pat Gleason, Member of the Governing Board; Pat Walker and Michelle Pearson. Mr. Gleason presented a grant check of $300,000 to the Mayor for the City's efforts to expand their aquifer storage and recovery capability. Aquifer storage and recovery is a water conservation technology. He applauded the tremendous initiatives of the City, the Utility Department personnel, and Utilities Director John Guidry. He announced that he had received 35 cards regarding the Nickels Road property. He held up a flyer (flyer is marked "Attachment A" and is part of the original minutes on file in the office of the City Clerk), which he said was completely wrong and untrue. Mayor Broening read the following statement regarding the Nickels Road property: Statement by Mayor Broening of the City of Boynton Beach, Florida Concerning Nickels Road Site Good evening. The City Commission meets on the first and third Tuesday of the month. Our procedure for business is to have the public audience at the beginning of the meeting. Tonight we will follow that custom with one minor change. T would like to comment on an item that I know a number of you wish to make comments on. My purpose in doing so is to share some facts regarding the issue with you so that you are aware of the City's position on this matter. The article that appeared in the Sun-Sentinel on March 11, 2002 was an article that followed previous stories on the Heart of Boynton in both the Palm Beach Post and the Sun-Sentinel. The press has given the Heart of Boynton project a great deal of attention and justifiably so as it is a very important project for the City. However, one sentence in the March 11, 2002 article seems to have caused a furor in an area of unincorporated Boynton Beach near Lawrence Road. T'II read the sentence from the article and then comment on it: "To revamp the Cherry H/lis pub/lc housing area, the C/O/ hopes to persuade the Palm Beach Couno/ Housing Author/O/to agree to a land swap. The authodO/ which owns the public housing development (at Cherry H/7/s), wou/d g/ve that to the C/O/ /n exchange for vacant/and the C/O/ owns just west of the Boynton Beach I~a// off Lawrence Road. "Source: "Some Families Fear Losing Homes to Boynton Redevelopment." Sun-Sen#ne/Page JB. As a practical matter, relocation of residents from the Cherry Hills area to this area is not viable for several reasons: 1. The time frame for the City's implementation of the Heart of Boynton is faster than any development approvals, if such approval is granted, for this property. :It is likely that current residents of Cherry Hills would not want to relocate to the Nickels Road property. Our discussions with residents in Cherry Hills have focused on developing neighborhood associations that would support relocation of the residents to locations in the environs of Cherry Hills or other locations closer to work, schools and family. Meeting Minutes Regular City Commission Boynton Beach, Florida March :L9, 2002 The Heart of Boynton Plan (page 45) calls for the City of Boynton Beach to work with the Palm Beach County Housing Authority to issue what are called "Section 8 Certificates" to the residents of Cherry Hills. These certificates allow the residents to move to quality housing in neighborhoods they wish to move to. In many cases the residents of Cherry Hills will want to move back to their old neighborhood when replacement owner occupied housing of better quality is available. We want them back because they have been contributing to the Boynton Beach community for many years. No change in the City's own land use plan for the west Boynton property is contemplated. The City's comprehensive land use plan for this neighborhood was approved by the City Commission on November 7, 1989 as Ordinance 89-38 which calls for this area to be developed as Iow- density single-family and open space. Specific to the City property, let me read the section of the plan as follows: 'The O'er should oppose development on the vacant por#on of Boynton ~Vest subdivision which exceeds dens/#es on the adjacent developed po~'on~ exceeds a 2-story building heigh~ or which would alter the single-family character of the area. A possible use of the vacant propert~ /n this area would be a neighborhood par~ on the property owned by the C/~ or a d/st#ct par~ if the property owned by the O~ were to be comb/ned w/th the other large vacant parcels /n the v/c/n/~. " Accordingly, the City's long-range plan for the area is stated as above because this is a policy statement approved by the City Commission. This does not preclude development of the property as Iow-density single family, nor does it preclude the Palm Beach County Housing Authority from developing the property they own. ! cannot speak to any plans the Housing Authority has for the property they own. T personally have not seen any plans nor can ! confirm that any plan exists. The Housing Authority property is in county jurisdiction as is the City property. Any plans would be subject to the Palm Beach County review process. The Palm Beach County land use designation for the Nickels Road properties is medium density residential and the zoning for the property is currently RS, which is residential single family. However, as a practical matter, the timing of any development of the Housing Authority property and proposed use of City owned property for uses other than open space or park use is subject to Palm Beach County zoning and also should follow the City's own comprehensive land plan. The City has had discussions off and on for the past six years with the Housing Authority as to the use of their property and the City's in this area. However, these discussions have been at a staff level only. As a matter of fact, the City Commission has not acted on any specific proposal for any use of the City owned property in this area. The City Commission will not act on any proposal to change any planned use of any property owned by the City or in its jurisdiction until 4 Meeting Minutes Regular City Commission Boynton Beach, Florida March 19, 2002 the facts are presented and reviewed, Palm Beach County consulted and the residents in the area involved. Respectfully, Gerald Broening, Mayor City of Boynton Beach, Florida March 19, 2002 Mayor Broening said that there is no plan for the use of this property. The flyer that the citizens received is inaccurate. :It is very clear that this Commission and our own ordinance would prohibit any such activity. Mayor Broening then asked if anyone still wished to speak on the subject. Scott Baird, 3886 Aladdin Avenue, said that the Mayor called the flyer inaccurate and wrong but did not say it was not happening and it was false and a lie. Mayor Broening then said it was not happening, it is false and a lie. Mayor Broening said that the property is owned by the City but is in the County's jurisdiction. There have been historic reports of discussions at the staff level of swapping lands but that is not happening. 3ud .1ones, 9341 Longmeadow Circle, said that someone from his neighborhood had spoken to Wilfred Hawkins and he stated that they were going to build 46 units of condos and quadplexes, Mr..]ones wanted to know how he could say this if there are no plans. Mayor Broening said that nothing has come before the City Manager or the City Commission. The official position of the City is the statement that Mayor Broening just read. David Voellinger, 9810 Nickels Boulevard, thought that the Mayor's statements sound to him as though it has been discussed but not officially. Mayor Broening said that there probably have been discussions but it only gets credibility when it comes before the City Commission and senior staff as a proposal. Anthony Morris, 3779 Edgar Avenue, read a letter to the Commission. A copy of the letter is marked "Attachment B" and is part of the original minutes on file in the office of the City Clerk. When questioned by 3elf Herlihy, 3800 Barkis Avenue, City Manager Bressner said that both the City owned property and the Palm Beach County Housing Authority property are in unincorporated Palm Beach County and subject to their zoning and planning. Mr. Herlihy asked whether Palm Beach County had eminent domain over City property and City Manager Bressner said he did not know but would find out. Brent Braunworth, 506 Whispering Pines Road, requested that the residents be kept informed on what is going on. Meeting Minutes Regular City Commission Boynton Beach, Florida March 19, 2002 Bob Kruger asked whether the land swap has been completed. Mayor Broening said there has not been a land swap or any plan for the use of that property. There is no desire to change the land use. City Manager Bressner said that if the County wanted to change the land use, they would have to hold a series of public meetings. The land use in the County has been in place for a number of years and he is not aware of any proposed changes but suggested that Mr. Kruger contact elected officials at the County level for confirmation. Mr. Kruger said that he understood that this land was donated to the City and it was designated for a park. City Manager Bressner said that the deed says it is to be used for a public purpose. Lisa Vatulla, Coelebs Avenue, asked how the citizens could lobby to make this property a park and was told they would have to lobby both the County and the City. City Manager Bressner said that some money from the County would be needed to put in a recreational use. He suggested that Ms. Vatulla supply him with a list of ten people in this room to work with the City on this. Leticia Swift~ 3863 Edgar Avenue, asked whether a land swap could happen and Mayor Broening said it could not with this City Commission, Mayor Broening said that there would have to be public hearings before any there could be any land use changes. A gentleman from the audience asked why there were surveyors in that area today. City Manager Bressner did not know but will find out. Patty Herlihy, 3800 Barkis Avenue, asked for the names of any neighborhood associations referred to in the Mayor's letter, statement #2. City Manager Bressner answered that they are being established now. None have been created yet. A gentlemen who lives on Nickels Road said that he recently purchased his home and was concerned regarding the real estate values going down. Brian Edwards, 629 NE 9th Avenue, said that he does not live in the neighborhood that is affected. However, over the last 13 months there have been many community meetings regarding the Heart of Boynton and how these people could upgrade their community. He does not know where the public housing vouchers will place people but they have a right to live wherever they choose. Everything about the Heart of Boynton has been a matter of public record and everyone in the City has been invited to be part of that process. :In order to build public housing in any neighborhood, it would require the City and the City Commission to be intimately involved in discussing this with the neighborhood associations. A gentlemen who lives at 9347 Long Meadow Circle said that there is a lot of trash on that vacant land and since the City is the owner, they should clear it. Mayor Broening said that in the last four or five years the City has made a wholehearted attempt to involve its citizens in major decisions. He applauded the residents for coming to the Meeting Minutes Regular City Commission Boynton Beach, Florida March 19, 2002 meeting tonight. He told them that they can call him at home any time and gave his telephone number. This concluded the portion of the Public Audience regarding the Nickels Road property. Butch Miller, 1401 Neptune Drive, said that he addressed the City Commission two weeks ago with two questions but he does not feel he has received a good response. His first question was "Why was the Commission so tax driven?" This question was not addressed. His second question was "Who paid for Commissioner McCray's trip to China?" He was given an answer of who did not pay; however, he wanted to know who did pay. Robert Motchkavitz, Director of Development for Premier Gateway Center at Quantum, took exception to a recent article in the newspaper, which expressed an unfavorable opinion regarding development activities at Quantum Park. He said that the market has softened since 9-11. Mr. Motchkavitz said his company owns approximately 54 acres in Quantum Park. They doubled their investment in Boynton Beach over the past two years because of the level of cooperation and service they received from the City staff. He is very proud to be in Boynton Beach. He has not always agreed with City staff but in every case, the dealings have always been professional, courteous and timely. Eric .lohnson of Quantum Park, said he was excited to be a part of the City. Terry Iiames, 656 NW 1't Avenue, said that she has not received an answer to her question at the last City Commission meeting regarding Krispy Kreme and the 24-hour drive through window. She also suggested that the fate of the 70-year old high school be placed on the November ballot as a referendum. This building could play a big part in downtown Boynton Beach, Assistant City Attorney Cirullo said that the City's review and approval of the Krispy Kreme development is in legal proceedings and as long as litigation is pending, the City cannot respond to her question. Herb Suss, resident of Boynton Beach, commented on the following: · Thanked Wilfred Hawkins for the written reply he received regarding his suggestion on televising Commission meetings. · Thanked all the Commissioners for their donations for books at the Library. · Asked whether it was feasible on Saturdays and Sundays, during the season, to reserve a certain amount of parking spaces at the beach for City residents who have beach decals. · Said that the City is moving too fast on apartment development. They will tax the Police and Fire Departments and our water supply. III. OTHER: A. He announced that there would be a shuttle service from the Boynton Beach Mall. Meeting Minutes Regular City Commission Boynton Beach~ Florida March :L9~ 2002 3. Presentation by the Boynton Beach Sister Cities International Steering Committee - Jeanne Heavilin, Committee Chair Jeanne Heavilin said that a steering committee was created at the November City Commission/Chamber Workshop. The steering committee recommended 1)forming an independent Boynton Beach Sister Cities Committee to advise and recommend sister cities activities and programs, 2)provide seed money and assistance to facilitate the organization and 3)incorporation of a sister cities committee in Boynton Beach. This would be through private funding and fundraising. They are not requesting any money. After the City and the Chamber of Commerce approve a sister cities committee, bylaws would be provided for review and approval, officers elected and the committee incorporated as a not-for-profit corporation. Ms. Heavilin introduced members of the committee who were present. They were: Bob Ensler, Stormi Norem, Ann Centi, Mayor Broening and liaison Dale Sugerman. She said that the committee is asking for the Commission's endorsement to proceed with the recommendations. Mayor Broening said that $1,000 for the start up would be required from the City and/or the Chamber of Commerce. However, the intent is for the organization to be self-supporting. City Manager Bressner said that if the Commission desires to pursue this matter, it would be appropriate to have a resolution supporting this program. Tf there were to be any contribution, either in funding or in-kind, that would be included as authorization within the resolution. We would also request that the Chamber of Commerce adopt a similar resolution. The City resolution will be on a future agenda. OR AS SOON THEREAFTER AS THE AGENDA PERMZTS Reduction of the Stormwater Utility rate charged to customers from $6.00 per ERU per month to $5.00 per ERU per month (Proposed Ordinance No. 02-012) City Manager Bressner said that the Public Hearing is to determine whether or not it is appropriate for the Commission to consider a reduction of the Stormwater Utility rate from $6.00 per ERU per month to $5.00 per ERU per month. Rates for commercial and industrial properties, which are calculated on a square footage bases, would be reduced approximately 17%. Staff believes that funds of approximately $5.4 million are available in the Utility Fund for stormwater projects and that would allow for a reduction in the stormwater ERU. There had been discussion of a further reduction in the rates. However, the recommendation was to consider that in the future when we have information on other costs, such as water utility improvements and the Everglades restoration. By the .luly budget meetings, staff should know whether it would be possible to go a next step lower in rates. Mayor Broening opened the Public Hearing. Meeting Minutes Regular City Commission Boynton Beach, Florida March 19, 2002 Dom Desiderio, 2755 S. Federal Highway, appreciated any relief that the small businesses could receive on the stormwater rate. He said that on September 30, 2001, the accountant said there was $90 million in the combined utility fund. On November 6, 2001, Dale Sugerman said there was $62.5 million in the fund and if the City completed every stormwater project in three years, the City would have $16.5 million. On .~anuary 23, 2002, there was a statement in the paper that said there was $55.8 million in the fund. Mr. Desiderio said that if these numbers are correct, the fund has dropped $35 million and the fund would be broke by the end of the year. He questioned the bid for Pond B and was advised to meet with Assistant City Manager Sugerman. Assistant City Attorney Cirullo read proposed Ordinance No. 02-0:[2 by title onlyI Motion Commissioner Ferguson moved to approve proposed Ordinance No. 02-012. Other: Code Review DCRV 02-001 Request that Chapter 2-Zoningl Section 8.5.A.9 of the Land Development Regulations be amended to allow for the sharing of parking resources within the IVlartin Luther King Boulevard Overlay District Quintus Greene, Development Director, said that he is bringing to the Commission a staff recommendation that has gone through the CRA. The overlay district was established in June 2000 and includes properties fronting Martin Luther King Boulevard (10th Avenue) between Federal Highway and Seacrest Boulevard. It was established to help facilitate development by providing different standards for that strip. The CRA recently voted to expand the CRA core area to encompass the IVlartin Luther King Overlay District. Staff proposed, and CRA agreed, to put in place the same shared parking criteria in this Overlay District that exists in the Central Business District. In addition, staff is bringing forward for Commission consideration another criteria of the Central Business District, which is a 50% reduction in the required number of parking spaces. These two recommendations will help spur development. Notion Commissioner Ferguson moved to authorize staff to prepare an ordinance to include CRA and staff recommendations regarding shared parking and a 50% reduction in the required number of parking spaces. It has, come to our attention that the assistant city manager, Mr. Wilfred Hawkins has plans to renovate and beautify an east section of Boynton Beach. This project is called The Heart of Bo.vnton Beach Project. , This project will have a direct effect on ourproperty values!! Here is why: There is a subdivision on the east side 0fBoynton called Cheri'y Hill, which can also be described as a Public Housing Enclave. Information gathered so far suggests an attempt to land swap with the Homing Authorities for the development of a'46 um't housing project. The property planned for this swap is OUR BACK YARD!! They want to build new public housing on the property (parcels owned by the Public Housing Dev. and The City of Boynton Beach)directly behind Westside Baptist Church on Nickles Road. The property is divided by a canal that runs east-west off of Lawrence Road for Section L If you cannot visualize this area take a short drive and agree it is much too close to our homes. Cherry Hill currently holds one of the cities highest rates of unemployment at 8.2%. This rate is double that of the entire city of 4.:5% and 4.4% for Palm Beach County. The area is also know for its 'high crime rate and is infiltrated with drug and gang related violence. Again, this is the area the city wants to relocated to OUR BACK YARD!Il! Tonight we will follow that custom with one minor change. I would like to comment on an item that I know a number of you wish to make comments on. My purpose in doing so is to share some facts regarding the issue with you so that you are aware of the City's position on this matter. The article that appeared in the Sun-Sentinel on March 11, 2002 was an article that followed previous stories on the Heart of Boynton in both the Palm Beach Post and the Sun-Sentinel. The press has given the Heart of Boynton project a great deal of attention and justifiably so as it is a very important project for the City. However, one sentence in the March 11,2002 article seems to have caused a furor in an area of unincorporated Boynton Beach near Lawrence Road. '11 read the sentence from the article and then comment on it: "To revamp the Cherry Hills pubfic housing area, the City hopes to persuade the Palm Beach County Housing Authority to agree to a land swap. The authority which owns the public housing development (at Cherry Hills), would give that to the City in exchange for vacant land the City owns just west of the Boynton Beach Marl off Lawrence Road." As a practical matter, relocation of residents from the Cherry Hills area to this area is not viable for several reasons: 1. The time frame for the City's implementation of the Heart of Boynton is faster than any development approvals, if such approval is granted, for this property. It is likely that current residents of Cherry Hills would not want to relocate to the Nickels Road property. Our discussions with residents in Cherry Hills have focused on developing neighborhood associations that would support relocation of the residents to locations in the environs of Cherry Hills or other locations closer to work, schools and family. -2- The Heart of Boynton Plan (page 45) calls for the City of Boynton Beach to work with the Palm Beach County Housing Authority to issue what are called "Section 8 Certificates" to the residents of Cherry Hills. These certificates allow the residents to move to quality housing in neighborhoods they wish to move to. In many cases the residents of Cherry Hills will want to move back to their old neighborhood when replacement owner occupied housing of better quality is available. We want them back because they have been contributing to the Boynton Beach community for many years. No change in the City's own land use plan for the west Boynton property is contemplated. The City's comprehensive land use plan for this neighborhood was approved by the City Commission on November 7, 1989 as Ordinance 89-38 which calls for this area to be developed as Iow-density single-family and open space. Specific to the City property, let me read the section of the plan as follows: "The City should oppose development on the vacant portion of Boynton West subdivision which exceeds densities on the adjacent developed portion, exceeds a 2-story building height, or which would alter the single-family character of the area. A possible use of the vacant property in this area would be a neighborhood park, on the property owned by the City, or a district park, if the property owned by the City were to be combined with the other large vacant parcels in the vicinity." Accordingly, the City's long-range plan for the area is stated as above because this is a policy statement approved by the City Commission. This does not preclude development of the property as low-density single family, nor does it preclude the Palm Beach County Housing Authority from developing the property they own. I cannot speak to any plans the Housing Authority has for the property they own. I personally have not seen any plans nor can I confirm that any plan exists. The Housing Authority property is in county jurisdiction as is the City property. Any plans would be subject to the Palm Beach County review process. The Palm Beach County land use designation for the Nickels Road properties is medium density residential and the zoning for the property is currently RS, which is residential single family. However, as a practical matter, the timing of any development of the Housing Authority property and proposed use of City owned property for uses other than open space or park use is subject to Palm Beach County zoning and also should follow the City's own comprehensive land plan. -3- The City has had discussions off and on for the past six years with the Housing Authority as to the use of their property and the City's in this area. However, these discussions have been at a staff level only. As a matter of fact, the City Commission has not acted on any specific proposal for any use of the City owned property in this area. The City Commission will not act on any proposal to change any planned use of any property owned by the City or in its jurisdiction until the facts are presented and reviewed, Palm Beach County consulted and the residents in the area involved. Ch~vez Staff Writer March 11, 2002 BOYNTON BEACH · Sitting on the porch of the house his grandfather built 44 years ago, Michael Roberts remembers all the children and grandkids raised in the three-bedroom, one-bath house -- 40 children who have darted in and out of the doors and played in the yard. Roberts, 43, worries that the bluish-gray house won't be around for future generations. It stands within a roughly one-square-mile redevelopment zone in the city's northeast side where officials want to tear down the 46-unit Cherry Hills public housing enclave and make other improvements to the long neglected area. But while some of the 3,166 residents of that zone want the improvements, they also fear bulldozers will claim their homes. Officials say the overall project, called the Heart of Boynton, encompasses everything from landscaping to rebuilding homes to public programs. That, city officials say, can only improve the area. 'I like the area, and I hope they would do something for it," Roberts said. But would he sell his home for the greater good? "I don't think so, because it's our family home. I'm still here. My dad's still here. Everybody was raised here," he said. "I got a lot of memories about this place." The targeted redevelopment zone an area of about a square mile bounded on the north by the C-16 canal, on the south by Northeast Third Avenue, on the west by Interstate 95 and on the east by railroad tracks. It's also an area that has an unemployment rate of 8.2 percent, almost double that of the whole city at 4.5 percent and 4.4 percent for Palm Beach County. Under the plan, still in its infancy, resident involvement is key. Neighborhood associations are already springing up in an attempt to get people involved. Residents agreed to rename the area Poinciana Heights, dropping the Cherry Hills moniker to give themselves a fresh start. But that spurt of activism has not negated the biggest fear: losing homes and being forced out of the neighborhood. - America's Gateway to the Gulfstream Wilfred Hawkins, assistant city manager, said that won't happen but understands the fear. "That kind of reaction is kind of expected," said Hawkins,' who is black. "Black people, in general, might be suspicious of government. But we're not trying to push anyone out." However, Hawkins said people living in Section 8 subsidized housing might be given vouchers to help them find homes elsewhere. The preference, he said, is to bring them back to better housing in Poinciana Heights. "These people who need better housing can get better housing," Hawkins said. "The majority of Cherry Hills that we're talking about is substandard housing, and you can't convince me that they don't deserve better. "I cannot understand why anyone would not want a fellow human being to live in better conditions." But what if homeowners overwhelmingly reject the city's direction? In the 1980s, pizza delivery workers refused ~o go there. Police patrolled with two officers per car, rather than the usual one. Streetlights were knocked out, and rocks, boUttes and glass littered the streets. Through the years, officials worked on fixing the problems. There are also about 45 acres of undeveloped property, 13 acres of which are owned by the City of Boynton Beach, and 8 acres which are owned by the Palm Beach County Housing Development Corporation. The existing developed area consists of single-family housing at a densi~r of about 4.5 dwelling units per acre. Annexation of the developed portion of Boynton West Subdivision, on a lot-by-lot basis would be impractical, however, annexation by referendum or other legal means should be pursued. Annexation of the undeveloped portion is unlikely due to the existence of the developed lots which intervene. The City should oppose development on the vacant portion of Bovnton West subdivision which exceeds densities on the adjacent developed portion, exceeds a 2-story building height, or which would alter the single-family character of the area. A possible use of the vacant property in this area would be a neighborhood park, on the property owned by the City, or a district park, if the property owned by the City were to be combined with the other large vacant parcels in the vicinitv. To the extent that these properties are reserved for or developed as parks, they should be placed in the Recreational land use and zoning categories. Since septic tank pollution is a problem in this area, the City should attempt to provide both water and service to these properties, and should consider placing these properties in a special assessment district, if annexed, or make a similar arrangement with Palm Beach County until such time as annexation occurs. Any annexation which does occur in this area, however, should also include the adjacent rights-of-way for Lawrence Road and Old Boynton Road. Commercial zoning should not be permitted along Old Boynton Road, in order to prevent the aesthetic and traffic safety problems that would accompany strip commercial development. Commercial development would also create and ~ntrusion into the single-family neighborhood which lies to the north. The Heart of Boynton Redevelopment Master Plan Heart of Boynton contains 18 churches covering a wide range of denominations. The location of these churches in the study area has both positive and negative impacts. Churches represent an important source of leadership if church leaders can form an active Ministerial Alliance (which has yet to develop). On the negative side, there are probably too many churches located in such a small area. The churches do not contribute advalorem or TIF moneys to the CRA and several churches are in violation of parking requirements and other LDRs and several are in need of major facade improvements. Constraints are largely confined to a limited number of issues: (1) Cherry Hills Public Housing (and its image to the entire area), (2) Boynton Terrace, (3) Small commercial businesses catering to these two developments (EZ Mart, etc.), lack of developable acreage, and (5) upkeep of vacant parcels and general code enforcement.
