(1) gl! buildings cons%muc%ed, in any 9moup ca%ion, shall ~eceive structural pes~ t~ea~ment as defined in ~his O~dinanoe, (B) (1) Any of %he fotlo~ino chemicals at not less ~han ~he designated concentmations shall be used treatment. (a) B~nzsne hexach~ ~o be used at a con- cen~ra%ion of 0.8 pem ~eni, applied in a v~ate~ emulsion. (b) Ch!ordan. __e~ 7o be used at a concentzation of !.0 per cent applied in a wate~ emulsion. -- I -- (c) (2) (c) Dieldrin~ To be used at concentration of 0.5 per cent applied in a water emulsion. (d) ..A.ldrin~ To be used at a concentration of 0.5 per cent applied in a water emulsion. Other materials may be used provided they meet the following requiremnets. (a) They are determined to be acceptable by the FHA, Architectural Standards Division~ ¥~fashington, D.C,; or, (b) ~hey meet a 5 year test conducted by the U~. Forest Service, U~S~ Dept. of A~riculture ~ or, (c) They contain one or more of the above mentioned chemicals in the concentrations recomended. (d) In all cases, evidence is provided that no toxic effects to humans~ beneficial plant or animal life will result from their use. (3) All materials shall be mixed and applied in strict conformance with manufacturer's instructions. Application. (1) Slab on ground construciion. (a) Apply on over-all treatment under entire surface of floor slab including porch floors and entrance platforms. Apply at rate of 1 gallon per 10 square feet, except that if fill under slab is gravel or other coarse absorbent material, apply at rate of 1 gallon per 7 square feet, (b) Apply to critical areas along both sides of foundation wall at rate of 1 gallon per 2-t/2 lineal feet per foot of depth. (c) Voids of unit masonry foundation walls, apply to voids at rate of 1 gallon per 5 lineal feet. (2) Basement or crawl space construction. -2- (a) Apply to critical areas along foundation ~alls~ a~ound piers and under slabs of porches and entrance platforms. (b) Apply at a rate of 1 gallon per 2-1/2 lineal feet per foot of depth along both sides of foundation walls, piers, etc. . (c) Under porch floors and entrance platforms, apply over-all treatment at rate of 1 gallon per 10 squaz~e feet. (d) Voids of unit masonry foundation walls and piers~ apply to voids at rate of 1 gallon per 5 lineal feet. (3) Trea'~men% e~c. Treatment shall not be made when the soil o~ fill is excessively wet or immediately after heavy rains, to avoid surface flow of the toxicant from application si'ge, Unless the treated areas are to be imme- diately covered, precautions shall be 'taken to prevent disturbance of the treat- ment by human or animal contact with the treated soil. .Sec%ion 2~ Before any slab inspection is given by the Euild- ~u~ P~p~r~meat for the continued construction of any improvements on any property in the City of Boynton Beach~ the owner of said property or his contractor shall furnish the Building Department with a certificate from an exterminator~ licensed in this City, that the soil has been treated rom termites as provided herei~ or by the owner of the p~operty if he has done this work. Section 3: Separability% £ach of the provisions of this Crdinance are separable, including word, clause, phrase or sentence, and if any portion hereof shall be declared invalid, the remaining portion shall not be affected but shall remain in full force and effect. ~$ection ~ Authoritv 'lo Codifv~ Specific authority is hereby cjranted to codify and incorporate this (~rdinance in the City's existin~ Code. -3- g_ec%ion_ 53_ ReDea!,ing. Provisions~_ All ordinances or paz'ts of ordinances in conflict herewith are hereby repealed. 2ection 6~ Pena. l.i.-y Provi.s.io~ Any person, firm or corpor- ation convicted of violating the provisions of this Ordinance shall~ upon conviction thereof, be penalized by fine not exceeding $500.00 and cos'Ls of prosecution, or imprisonment no% exceeding ninety days~ or by both such fine and imprisonment, Section 7~ Effe_c.%_ive Da~e_i This Ordinance shall become effective in '~he manner and at the tima p~ovided in the chsrter and Ordinances of the City of Boyn%on ~each~ Florida. ~irst reading 'this 16'Lh day of December, A.Do 1968. :3econd, final reading and passace this 6th day of January~ 1969, ATTEST a City Clerk SEAL
