O68-03ORDINANCE NO. 68-~ AN EMERGENCY ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING SECTION 17-49(a) OF THE CODIFIED ORDINANCES OF SAID CITY, PROHIBITING POSSESSION AND DISCHARGE OF DANGEROUS WEAPONS WITHIN SAID MUNICIPALITY; PROVIDING A SAVINGS CLAUSE; RE PEA LING PROVISIONS; PENAL TY CLAUSE; AUTHORITY TO CODIFY; AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. PREAMBLE This Ordinance is deemed to be an emergency measure enacted for the immediate preservation of the public peace, property, health and safety of the inhabitants of the CITY OF BOYNTON BEACH, FLORIDA, and for the effective daily operation of said municipality. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA: SECTION 1: That Section 17-49(a) of the codified ordinances of the CITY OF BOYNTON BEACH, FLORIDA, is hereby amended to read: Section 17-49(a) "It shall be unlawful for any person within the city limits to have in his possession, except within his own domicile, or carry, use, fire or discharge a revolver or pistol of any description, shotgun or rifle which may be used for the explosion of cartridges, or any airgun, BB gun, gas- operated gun or spring gun, or any instrument, toy or weapon, commonly known as a "peashooter", "slingshot", or "beany", or any bow made for the purpose of throwing or projecting missiles of any kind by any means whatsoever, whether such instrument is called by any name set forth above or by any other name. !' SECTION 2: Separability: Each of the provisions of this are separable, including word, clause, phrase, or sentence, and if provision hereof shall be declared invalid, the remaining portion shall be affected but shall remain in full force and effect. SECTION 3: Repealing--Provisions: Ail Ordinances or parts of in conflict here.ivith are hereby repealed. SECTION 4: Authority to Codify: Authority is hereby granted :o codify and incorporate this Ordinance in the City's existing Code. SECTION 5: Penalty Clause: Any person, firm or corporation convicted of violating the provisions of this Ordinance shall, upon conviction thereof, be penalized by fine not exceeding $500.00 or by imprisonment in the municipal jail for a period not exceeding ninety (90) days, or by both such fine and imprisonment. Any day upon which a violation exists or continues shall be deemed a separate and distinct offense. SECTION 6: Effective Date: This Ordinance is deemed to be an emergency measure and shall take effect immediately upon passage. FIRST, FINAL reading and adoption this ~day of~.~~y · A.D. 1968.
