O68-01ORDINANCE NO. 68-_~ AN EMERGENCY ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA, ADOPTING, BY REFERENCE, AS VIOLATIONS {DF THE CODE OF ORDINANCES OF THE CITY OF BOYNTON BEACH, FLORIDA, ANY ACT WHICH IS OR SHALL~.BE RECOG- NIZED BY THE LAWS OF THE STATE OF':'F~LoRIDA AS A MISDEMEANOR; PROVIDING A SAVINGS CLAUSE, REPEALING PROVISIONS, PENALTY CLAUSE, AUTHORITY TO CODIFY, AN EFFECTIVE DATE, AND FOR OTHER PURPOSES. PREAMBLE This Ordinance is deemed to be an emergency measure enacted ~or the immediate preservation of the public peace, property, health and safety of the inhabitants of the CITY OF BOYNTON BEACH, FLORIDA, and for ;he effective daily operation of the municipal Police Department. BE IT ORDAINED BY TI-rE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA: SECTION 1: That Section 17-42.1 of the codified ordinances of the CITY OF BOYNTON BEACH, FLORIDA, which is set forth in full herein- after is hereby re-enacted and re-adopted: Section 17-42.1. State misdemeanors. "It shall be unlawful for any person to commit, within the corporate limits of the City of Boynton Beach, Florida, any act which is or shall be recognized by the laws of the State of Florida, as a misdemeanor, and the commission of such acts is hereby forbidden and declared a violation of this s ection. "-Whosoever shall violate the provisions of this section, upon conviction thereof, shall be punished by the same penalty as is therefor provided by the laws of the State of Florida, but in no case shall such penalty exceed a fine of five hundred dollars ($500.00) or imprisonment for more than ninety (90) days, or both fine and imprisonment in the discretion of the municipal judge." SECTION 2: Separability_. Each of the provisions of this ordinance are separable, including word, clause, phrase, or sentence, and if any provision hereof shall be declared invalid, the remaining portion shall no~ be affected but shall remain in full force and effect. SECTION 3: Repe. aling Provisions: All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4: A_.uthorjty to Codify: Authority is hereby granted to codify and incorporate this ordinance in the City's existing code. SECTION 5: Penalty Clause: Any person, firm or corporation convicted of violating the provisions of this ordinance shall upon conviction thereof, be penalized by fine not exceeding $500.00 or by imprisonment in the municipal jail for a period not exceeding ninety days or by both such fine and imprisonment. Any day upon which a violation exists or continues shall be deemed a separate and distinct offense. SECTION 6,;.
