O66-26AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA, DECLARING THE INTENTION OF SAID CITY TO EXTEND ITS MUNICIPAL TERRITORIAL LIMITS BY TI-rE ANNEXATION OF AN UNINCORPORATED TRACT OF LAND LYING CONTIGUOUS THERETO AND WITHIN PALM BEACH COUNTY, FLORIDA, TO WIT: P~RCELS OF LAND LOCATED IN GOVERNMENT LOT 2 OF THE SOUTHWEST QUARTER OF SECTION 34, TOWNSHIP 45 SOUTH, RANGE 43 EAST, PALM BEACH COUNTY, FLORIDA, AND LOTS 12 THROUGH 16, INCLUSIVE, BENSON BROS. SUBDIVISION, ACCORDING TO THE PLAT THEREOF RECORDED I~PLAT BOOK 5, PAGE 27, PUBLIC RECORDS, PALM Bt~ACH¢ FLORIDA, ALL MORE PARTICULARLY DESCRIBED HEREINAFTEI~; PROVIDING FOR REPEALING AND SAVINGS CLAUSE, AN EFFECTIVE DATE, ZONING PROVISIONS AND FOR OTHER PURPOSES. WHEREAS, the owner of a certain tract of land more particularly escribed hereinafter° lying adjacent and contiguous to the territorial limits .f the City of Boynton Beach, Florida, and within Palm Beach County, Florida, has petitioned the City Council for the annexation of said property by the City of Boynton Beach. Florida; and WHEREAS, subject ~racl contains less than ten registered voters; and WHEREAS, it is considered to be for the best interest of the City of Boynton Beach, Florida and for the owner of subject tract that same be annexed, and included within the municipal territorial limits of the City; NOW, THEREFORE, be it ordained by the City Council of the Cityof Boynton Beach, Florida: Section 1: That th~ City Council of the City of Boynton Beach, Florida, hereby declares its intention to annex the following-described tract of land to the municipal territorial limits of the City of Boynton Beach, Florida, at the expiration of thirty days from the passage of this Ordinance: Commence at the Southwest corner of Lot 16 BENSON BROS, SUBDIVISION, Plat Book 5, Page 27, public records PaLm Beach County, Florida; thence proceed Easterly along the South line of said Lot 16 BENSON BROS. SUBDIVISION and the ]Easterly extension thereof to a point in the West line of Government Lot 2 of the Southwest quarter (SW 1/4) of Section 34, Township 45 South, Range 43 East, Palm Beach County, Florida; Thence proceed Southerly along the West line of said Government Lot 2 to a point 1569 feet Southerly from the North line of said Government Lot 2; thence proceed Easterly along a line lying 1569 feet South from the Northl'ine of said Government Lot 2 to a point in the Easterly right of way of State Road A-i-A; Thence proceed Northerly along the East right of way line of said State Road A-1-A to a point 1321 feet Southerly from the North line of said Government Lot 2, of the Southwest 1/4 of Section 34, Township 45 South, Range 43 East, Palm Beach County, Florida; Thence proceed Easterly along said line lying 1321 feet Southerly from the North line of said Government Lot 2 to the waters of the Atlantic Ocean; thence proceed Northerly along the waters of the Atlantic Ocean to a point which is 1186 feet Southerly from the North line of said Government Lot 2; Thence proceed Westerly along said line lying 1186 feet Southerly from the North line of said Government Lot 2 to the point of intersection with the East boundary line of State Road A-l-A; thence proceed Northerly along the East line of said State Road A-1-A to a point due East from the North- east corner of Lot 12 BENSON BROS. SUBDIVISION, Plat Book 5, Page 27, public records Palm Beach County, Florida; Thence proceed Westerly to the Northeast corner of said Lot 12 BENSON BROS. SUBDIVISION and continue Westerly along the North line of said Lot 12 and the Westerly extension thereof to the point of intersection with the centerline of the Intracoastal Waterway Canal (FIND); Thence proceed Southwesterly along the centerline of said Intracoastal Waterway Canal tb a point due Westfrom the Southwest corner of Lot 16 BENSON BROS. SUBDIVISION; thence proce~ east e~l yto the point of beginning. Section 2: That subject property, upon annexation, shall be zoned :o authorize use as a Trailer Park, or in the alternative, as a condominium or co-operative apartment complex, pursuant to the provisions of Ordinance No. 62-9 of the City of Boynton Beach, Florida, constituting the master zoning code of said City. Section 3: Repealing Provisions: Ail ordinances or parts of s in conflict herewith are hereby repealed.
