AN E'MERGENCY ORDINANCE BY THE CITY OF
BOYNTON BEACH, FLORIDA, PERTAINING TO
GARBAGE AND TRASH COLLECTION WITHIN
SAID CITY; PROVIDING FURTHER FOR AUTHORITY
TO CODIFY; AN EFFECTIVE DATE; A SAVINGS CLAUSE;
REPEALING PROVISIONS; PENALTY PROVISIONS; AND
FOR OTHER PURPOSES.
PREAMBLE

Section 1.
City of Boynton Beach,

This Ordinance is deemed to be an emergency measure
enacted for the immediate preservation of the public peace, property, healt~
welfare and safety of the citizens of the City of Boynton Beach, Florida,
and for the effective daily operation of the Municipal Sanitation
Departm en~.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FLORIDA:
That Section 13-2 of the Codified Ordinances of the
Florida, be, and the same is, hereby amended
"Section 13-2 - Garbage cans required.
The occupant., of each household in the City is hereby required
To provide a garbage can or cans of sufficient capacity to hold four days'
accumulation of garbage from each household. With reference to multi-
unit residential rental buildings (more than two units), the responsibility
for providing said garbage can or cans for each household unit shall rest
with the landlord or owner of subject rental unit building or buildings."
Section 2. That Section 13-13 of the Codified Ordinances of
the City of Boynton Beach, Florida, be, and the same is, hereby
amended to read:
"Section 13-13.- Trash Containers Required.
The occupant of each household in the City is hereby required
to provide a trash container or containers of sufficient capacity to hold
four days' accumulation of trash from each household. With reference
to multi-unit residential rental buildings (more than two units), the
responsibility to provide said trash container or containers for each
household unit shall rest with the lanazord^of subject rental unit
building or buildings."
Section 3 - Separability. Each of the provisions of this
ordinance are separable, including word, clause, phrase, or sentence,
and if any provision hereof shall be declared invalid, the remaining
portion shall not be affected but shall remain in full force and effect.
Section 4 - Repealing Provisions. All ordinances or parts
of ordinances in conflict herewith are hereby repealed.
Section 5 - Authority to Codify. Authority is hereby granted
to codify and incorporate this ordinance in the City's existing code.
Section 6 - Penalty Clause__ Any person, firm or corporation
convicted of violating the provisions of this ordinance shall upon
conviction thereof, be penalized by fine not exceeding $500.00 or by
imprisonment in the municipal jail for a period not exceeding sixty
days or by both such fine and imprisonment. Any day upon which the
violation exists or continues shall be deemed k separate and distinct
offense.
Section 7 - Effective Date. This ordinance is deemed to be
an emergency measure and shall take effect immediately upon passage.
